Got this yesterday from a parking fine. As yet I have not replied to anything that I have been sent so there they are assuming im the keeper and the driver
Gone through the forum and various sections, great stuff btw. I have done the Aos on the mcol, so now am putting together a defence compiled of the paragraphs in the newbies section.
I am of the understanding I can cut and paste them in as they are, bar para 3 which is in my words. I am a little unsure what to put in this and what to tell them and what not to.
Some context is, the car was parked on an empty car park for little over 20 mins, which was a medical emergency. The only other alternative was the double yellow lined road, which could of been used as the driver is a blue badge holder, but there were road works and scaffolding there. Also the establishment the car park belonged to was not open on this day so was unable to put in any reg in their system. Do I go with one of many para 3s that people of shared, or do I put this detail in my own. I am a bit confused when I read if they have described the breach or not.
I hope you can help as I have read many of the posts are you guys are doing a great service.

I have completed the AoS. Do I use the Chan and Akande defence in place of para 3?

Correct, you address the deficient POC by countering with Chan and Akande, same as all the other similar cases over the last 9 months
No additions, no stories, no explanations, simple

I looked at all of the info in the template thread, the newbies thread and other peoples thread and will study this more as I know this isn't the end :). I have one question for my own curiosity if you can help. You said they havent pleaded a breach in the POC, what does an example of them doing this look like. They state in breach of the displayed terms of conditions - is this not explaining a breach.

Look at the thread list for titles saying 'claim form' there will probably be image of the POC within the thread. Here's a link to one that specifies the reason:

So , as I am a stranger to you, the alleged breach doesn't specify to me or to us, or to a judge, which specific term or rule on the sign was breached !
Does it mention, overstay, non payment, insufficient payment, parking outside the lines, not parked in a bay, leaving the site, no permit on display ? What. ? More than one. ? Two of them , 3 of them. ? Blue cars not allowed on a Monday. ?
Neither myself or a judge should have to ask. ! The POC does not say. !
Imagine being arrested by a police officer, without them telling you what for, then being convicted and fined £266.60p , but never knowing the reason why. !
So as the Chan and Akande judgments determines that it should be specified on the claim form, at the outset, , then the vagueness of your POC is apparent , totally lacking in clarity

I see, makes total sense that. Thanks for explaining. The more I read this stuff the more I understand and realise its just a load of nonsense dressed up.

With an issue date of 14/04/26 and having completed the AoS in a timely manner your defence deadline date is 4.00 p.m. on 18/05/26
