Parking Charge Notice ( PCN ) for Heathrow Hilton Garden Inn terminal 2 (t2) from EURO CAR PARKS
Hello guys Im working as a private hire driver, a while ago I've dropped customers at Hilton Garden Inn terminal 2 and for my surprise I've received a PCN ticket. Now I remember I've dropped customers long time ago there and had no problems before and I'm also opted in for the automatic drop-off payments system for Heathrow terminals and was expecting to be charged there if there was any drop-off charges. On the PCN states Contravention: ''The vehicle was parked without a valid pay by phone transaction''. The entry/exit time is 20:41:04-20:43:11. They show pictures only of my number plate. Now if I appeal it do I stand a chance because once I do I lose the right to pay their discounted price of £60 instead of the full amount of £100..... I also looked the other topics regarding the liability thing in other terminal drop-off but I'm not sure if it will work here as well as this is not directly terminal dropoff thing.. I've called the Hilton Garden Inn themselves but they are completely useless regarding the issue and told me to turn to EURO CAR PARKS as they dont bother at all with the carpark.

You'll never have to pay this invoice. This is why it doesn't matter if it's £60 or £100, that's really not a concern at any stage.
Show us the NTK to see the location, postcode, all dates, details & whether it claims to rely on keeper liability.
Only redact your name, address, VRM, car pics, any QR Code and the PCN number.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

A PCN for 2 minutes on site when the minimum consideration period is 5 minutes?!
Typical sharp practice from Euro Car Parks and a likely win at the POPLA stage.
Plus the Hotel is clearly within the airport boundary so there is no keeper liability at this location.
They should not be claiming that POFA applies here, it does not.Always remember to abide by Space Corps Directive 39436175880932/B:

This is an appeal by the registered keeper - No driver details will be given. Please do not bother with your known fishing expedition in an attempt to get driver details to try and get around the fact there is no keeper liability (and never can be under POFA).Due to this being airport land you will be well aware there is no keeper liability due to the byelaws in force and the fact this is not relevant land.
As there is no keeper liability then liability cannot flow from the driver to the keeper and thus is an auto win @POPLA . Please therefore cancel the notice or issue a POPLA code where you will auto withdraw
If you waste your time asking for driver details this will be ignored and you will still lose at POPLA if you dont cancel the PCN
So let's save my time and yours and cancel this PCN you simply cannot win this (and you know it).

It might well be a new one for ECP to handle, so let’s see how they deal with it. Their usual MO is to reject, so don’t be surprised. The worst you’ll come off with is a POPLA Code. Decide then how to progress, with further advice from us.

Correct, but I would add an extra sentence regarding the 5 minutes rule, after reading the appropriate section in the joint Code of Practice ( without revealing who was driving. )

Its in violation of The BPA Code of Practice consideration period which is the necessary time allowed for a driver to read parking terms, decide whether to accept them, and either park or leave, during which no parking charge can be issued. Effective from October 1, 2024, the new code typically mandates a minimum of 5 minutes for this period, often allowing for more time in larger, complex car parks.
Please therefore cancel the notice or issue a POPLA code where you will auto withdraw

Hi guys,
I am also a private Hire driver and have received a near identical letter.
I was also only dropping off customers and was also only there for two minutes.
I do have auto pay set up for airports but as this wasn't a terminal I figured there would be nothing to pay but I remember on the day I dropped off, looking for if I had to pay anything and there were no warning signs that I could see ?
Is the above letter that the Original poster is sending likely to work ??
Does anyone actually have any concrete experience with this ?
