ParkingEye for out of hours parking

Hey all. This is ridiculous, 20 years of driving with no parking tickets until suddenly getting one after the next now.

I have already submitted the blue letter appeal to ParkingEye (unchanged) and emailed this complaint to the retailer:

"I am writing to ask that you instruct your parking contractor, ParkingEye, to cancel a recently issued parking charge relating to your site in Winsford, Nat Lane.

The notice

alleges a stay of just 13 minutes. The images provided are taken in near-total darkness, and any signage would not have been legible to a driver on arrival. It is entirely reasonable that a driver would need time to enter, attempt to locate and read signage, and then leave.

The British Parking Association Code of Practice requires a reasonable consideration period. Issuing a charge in these circumstances appears unnecessarily aggressive and, frankly, predatory.

As a customer-facing business, I would hope you would not wish to be associated with this type of enforcement. I would therefore appreciate it if you could contact ParkingEye and request that this charge be cancelled.

I look forward to your confirmation.

I am only posting to make sure that I am focusing on the right points. The way I see it, those main points are:

  • No mention of the alleged contravention (no keeper liability)
  • evidence pictures show poor lighting
  • Insufficient consideration time, BPA breach. Under the lighting conditions, 13 minutes could be considered reasonable to locate signage, read, understand and agree to a contract
  • No evidence of landowner authority
  • No evidence of loss or damage

    What the letter states at the back is:

    "The signage, which is clearly displayed at the entrance to and throughout the car park, states that this is private land and that the car park is managed by Parkingeye Ltd. In addition the signage states that, as a maximum stay car park, a Parking Charge is applicable if the vehicle remains within the car par for longer than the 0 hours 0 minutes max stay time. The signage also contains further terms and conditions associated with this car park by which those who park in the car park agree to be bound."

    This does not allow time for consideration of the terms, as required by BPA?

    It is an unfair term to allow a zero consideration period. Just ignore this.
