Euro Parking Service PCN

Hello All,

This is my first post in the forum. Last week, I got a PCN from Euro Parking Service for parking at a shop front in Birmingham. I parked for less than 6 mins to get a bottle of water (from another shop nearby) and moved away. Here are the points in my defence.

1, The incident happened at about 11pm. During this time the shop was closed. I haven't caused any inconvenience to the business or to its patrons.

2, There were no markings/signs to indicate that I am entering a controlled parking zone. In fact, there are no parking bay markings. Its just a store front that can hold 3 cars.

3, The controlled parking sign was up there on the shop sign board and it was not well lit up. Honestly, just like most people, I do not look up at the shop's sign boards.

4, I was parked there for less than 6 mins (5min 42sec).. which might be within an allowed grace period.

I appealed the PCN but it was turned down indicating that I left the premise and the grace period is only applicable if I stay inside the car!

I am attaching the picture of the google location showing no parking bay marking or any other indications that its a controlled parking area. Further, the parking sign picture shows that it is not well lit up in the dark - there are reflections of the street lights!

Given the above scenario, I would like to check with more experience people in the group, if this is worth the time/cost/effort to challenge. Does it stand a chance to win (in a court or wherever) in my favour?

    I guess EPS sign up on the fascia would be difficult to read even in daylight. Try to get photo facing the shop frontage around 11pm.

    Have a read of the NEWBIES Announcement thread POST 4 and 2 and look at the Private Parking Sector Single CoP for accurate info on Grace periods. You'll realise what EPS said to you about Grace periods is a lie.

    It's always worth challenging a pcn. The NEWBIES, Template Defence threads and advice from forum members can help you through the process but only you can decide if it's worth your time. It was an expensive bottle of water!!

    Thanks Nelly.. Yes, I was thinking the same - Is it worth my time!!.. I think I should take it as an expensive bottle of water and move on.. 😥..

    But honestly, I would love to pursue this if I had the time. You never know, I may change my mind..😄

    Why would you pay?

    If you read the “Newbies” thread you will see that it will be them who waste their time and money whilst you sit back for a while until you get much further down the line

    Nobody is suggesting you pay!

    DO NOT PAY IT.

    Just ignore EPS (and all £170 demands, which take up none of your time or headspace) and come back if you get a LBC from Gladstones or whoever.

    Obviously you must tell them if you move house but that's common sense - in case a claim form is issued - not parking related.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
