I don't necessarily agree with your suggestion that people should just hand over more personal data to someone like Amazon, particularly if it's something like a copy of a passport which is treated as sensitive data under data protection laws - it will no doubt be stored by Amazon for as long as the OP has an account and then some.

Surely Amazon are handing off ID verification to a third party provider of such services, and are therefore unlikely to see, never mind store, OP's passport? A quick look at Persona's web presence suggests that corporate ID verification services are very much their core business, so it's naturally in their interests to preserve their reputation by taking all reasonable measures to protect any personal data they process and/or retain, although I agree that it's only natural to be sceptical about supplying personal data to any business (especially outside the UK's data protection jurisdiction), and all the more so when it shouldn't be necessary at all in the first place…

I'm sure Amazon already know far more interesting information about my lifestyle than they're ever likely to get from my driving licence…

I am aware of Persona and much like other ID&V companies, they process the data but it is their clients such as Amazon that control the data and it is up to them to delete it. Depending on the setup, either the data will be hosted by the ID&V company or it will be stored on Amazon’s own servers. Some companies even include terms in their contract with the right to sell that data.

The other thing to be concerned about is that the US has certain laws that allows government agencies to access someone’s data with or without a corder order. Those laws have can and have been abused by agencies. So it’s possible your data could be passed on to those agencies - Not a big deal if you don’t have plans to go to the US anytime soon but could pose a real problem in the future if you do.

In some circumstances requesting an id for verification may be justifiable such as fraud, but the current facts in the OP’s simply don’t fit that requirement. This kind of request is common in the US and I reckon the Amazon rep is just applying the same policy across the board with the result that Amazon passes off the issue as a ‘training error’

At the end of the day, it comes down to how much you value your personal data.

True, but to drag this thread back on topic, does the OP value their privacy at more or less than the £183 that Amazon won't consider refunding unless an ID check is done (or they are compelled by a court order).

So it is resonable that without handing over personal sensitive information, which OP does not actually have and was not requested to make the purchase in the first instance, Amazon will not fulfil their legal consumer obligations ?

Of course it's not "fair", but in the absence of anyone suggesting other options (other than chargeback or a small claims process) it's not clear to me how else Amazon can be persuaded to "fulfil their legal consumer obligations".

There really isn't any other options and it will be up to the OP to decide what route they prefer to take. Suppose the only other option is to complain to those consumer champion write-ins like the Guardian who might be able to put pressure on them to issue a refund without having to provide an ID.

Going public on The Socials or the Consumer Champion pages of the newspapers is only going to be a goer if there is a decent mawkish sob story to hang off it. So if those missing airpods were meant to fulfill the last wish of your granny/child/pet (all of which must be photogenic) or somesuch, there's not much chance.

  • My bank updated me about 45 minutes ago. They have credited me the amount, and are looking into it. Amazon has 120 days to respond to them, though usually (hopefully) the bank will hear back within 30 days. If my dispute is not successful, the bank will take the money back with 21 days’ notice.

I can’t imagine Amazon causing too much trouble about it, but we’ll see.

If there are any thrilling twists and turns between here and resolution, don’t worry, you will hear about them.
