PCN in Company lease vehicle. Driver identified by company

Hi all

A case where basically paid at the wrong machine for an NCP carpark (it seems very common based on the reviews....

Anyway my lad is using a company car and the company was sent the PCN. His company have seemingly identified him as the driver.

Is the advice srill to continue with the relevant points in the newbie thread jnsojte of being identified by his company? Thanks in advance

The letter reads:

The driver of the above vehicle is liable for a Parking Charge of £100. This charge relates to the period of parking specified in this document, the charge having been incurred on private land due to the following breach of the car park terms and conditions of use: Parked without payment of the parking charge, and liability for the same having been brought to the attention of the driver by clear signage in and around the site (XXXX Street) at the time of parking. The breach relating to the period of parking was recorded by an approved ANPR camera.

Payment is now required to the sum of £100, which must be paid no later than 28 days from the date this is given. However, if payment is received within 14 days from the date this is given, then a reduced amount of £60 will be accepted in full and final settlement.

A Parking Charge to Keeper has previously been served on the registered keeper of the vehicle containing full details of the charge.

We, National Car Parks Limited, are the creditor. We have been advised that you were the driver of the vehicle at the time that the parking charge was incurred and that you are liable for payment of the same.

Please be warned: that if, after the period of 28 days beginning with the day after that on which this is given, (i) the amount of the unpaid Parking Charge specified in this has not been paid in full, and (ii) we do not know both the name of the driver and a current address for service for the driver, we will have the right to recover from you, so much of that Parking Charge as remains unpaid.

Additional charges may be recovered from the liable party if debt recovery action or court proceedings become necessary. This is deemed to have been given to you on the second working day after the date of sending above.

You must choose to either pay OR appeal this. If you choose to pay, any subsequent appeal will not be heard

    They definitely cannot have identified the driver unless they witnessed him driving, which they didn't and wont swear to under oath ( its either Hearsay or an Assumption by the lease companyandby NCP . )

    They probably identified him as Hirer or Lessee, as they should do , an important difference

    If an NtH arrived in the post with his name and address on it, he appeals the NtH ( not the NTK ) by following the advice given by Edna Basher in the 1st post in the newbies thread, but do not identify who was driving

    He appeals as Hirer only ( private parking companies never comply with Pofa2012. )

    As they are in administration I don't believe NCP can partake in POPLA appeals because they can't pay the fee.

    Appeal as per usual for a NTH case, as hirer/lessee if he has received his own notice. He can't lose.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
