DCB LEGAL, UKPC court claim

Hi Everyone,

I received Claim Form from DCB Legal to take place at the Civil National Business Centre,its dated 02 April 2026, I'm not sure what to do

INCIDENT

I was driving to the North from Buckingham on the M1 , I stared out at 4:30 am, 90 mins later at around 6am i became really tired, I pulled into McDonalds at Markham Vale ,which is next to the M1 ,bought a coffee [which i have on my bank statement} parked up and then I fell asleep, I woke up two hours later and drove off,I never left my car the whole time.

I then received a parking fine from Parking Control Ltd claiming I had overstayed and issued me a fine, a week later on my trip up to the North I went into Mcdonalds spoke to the mangager ,they symathised and told me theyd sort it out, I showed them my bank with proof of purchase, I had stayed 8 minutes over the allowed 2 hour limit.

I responded to Parking Control ltd and told them i do not accept liability for the ticket,after on going correspondance with them , unfortunately i now have this Claim form warning of CCJ ,£278 fine etc.

Any advice would be grateful.

    It Definitely won't be happening at the CNBC in Northampton, a civil service government office , a central point

    Any court hearing will be at your local civil court

    Study the 2nd post in the newbies sticky thread in announcements near the top of the forum

    Complete the AOS stage online on MCOL ASAP, after studying that post first

    Post a redacted picture of the POC from the lower left of the claim form below after hiding the VRM details first

    Post a redacted picture of the top left of the claim form below after hiding your name and address first, leaving all the claimant details on show

    No personal information should be on show, so check carefully before posting pictures

    I believe that its UKPC via DCB LEGAL, not Parking Control Ltd , issue date 2nd April 2026

    Doesn't really matter what you put in the defence as they'll discontinue.

    They haven't adhered to the 10 minutes grace period though.

    Use the template defence and for paragraph 3 put something like:

    "The Defendant was a legitimate customer and purchased a coffee to drink in their car. The Claimant's previous paperwork states that the car was parked longer than permitted by 8 minutes (although this is omitted from their PoC in breach of 16.4(1)(e) and Practice Direction Part 16.7.5). This is false. This time period is simply the time between entry and exit ANPR camera captures of the vehicle and the parking period was obviously less. In any case, the Claimant is obliged to adhere to the joint private parking Code of Practice, which allows 10 minutes grace period in such a car park. When all is taken in to account the claim has entered the realm of de minimis and it is submitted that the claim should be struck out."

    As I suspected, its UKPC LTD, not what you wrote above, please edit your thread title to something more suitable like

    DCB LEGAL, UKPC court claim

    ok thanks everyone,not used to this so im going to spend some time working everything out,ive been on MCOL and registerd that i will contest the claim,I Beleive i should write down my defence on MCOL also,

    I will also change the title on this post, btw a month after this i went to the doctor who took a blood test and told me i was at high risk of diabetes, pre diabetes, i have it on my NHS app, dont know if thats relevant to my case

    Draft your defence in word first, based on the defence template in announcements, you will eventually copy and paste your final defence into the MCOL defence box, save and submit it ( no paperwork involved. )

    You are defending against the allegation in the POC, a contractual agreement, so I doubt that any health problems are useful, so probably not relevant to the case, save any background information for your future WS

    Your paragraph 3 was suggested earlier by car1980

    Add and driver to the end of paragraph 2

    Your final defence will be 10 paragraphs long, 8 of them unchanged

    Thank you very much, really appreciate it, i feel a lot better,even the worst case doesn't seem as bad as what i thought this morning,CCJ'S legal fees etc,seems fees are capped and i know how to respond,thats a good start,i'll go as far as it goes ,i wont pay unless a court demands it.

    Add into your para 3 this:

    Liability for any sum at all is denied as are all allegations, which have no lawful basis. In fact, when a complaint was raised, the McDonalds manager promised to sort it out (cancel the PC) but UKPC carried on. The Defendant's bank statement shows proof of purchase and it seems the Claimant has breached its own Code of Practice ('CoP') as the PC alleges an overstay of just 8 minutes over the allowed 2 hour limit. The CoP mandates at least 10 minutes and extra time for disabled motorists must be available and honoured. The Defendant has a long term medical condition (pre-diabetes diagnosed from a blood test around that time) and as such meets the Equality Act 2010 definition of disability. As a matter of fact and law (and per the CoP) more time must be allowed.
