HI all, I have received a claim form for parking on consecutive days between 22/03/2025 and 02/04/2025. Bit of a back story on this one is that the carpark is opposite to where I work and I had a verbal agreement to park there by the area manager of Jollies since September 2018 and have WhatsApp to prove this since this date - also had various charges during thus time and has cancelled them for me (again with WhatsApp messages back and forward). I also have correspondence from him when sending the pictures of the fines that he told me that he no longer works there and annoyingly didn’t tell me.

I have ignore all the previous fine letters until I got the letter before claim and at that point I responded by emailing DCB explaining that I had this in place prior and I didn’t knowingly enter into an agreement upon parking in the car park. I have requested the Extention online to 28 days stating that I will deputing in full - the charge is for £874.32 they have already tried to reduce this to £400 when I responded to the letter before claim, which I obviously didn’t accept.

I have had a look through the forum and couldn’t find anything that relates to my case but used the templates and emended them for the letter before claim. Any help would be appreciated, should I just reply with the above for my defence, luckily I saved all the WhatsApp messages.

No fines were issued, just invoices, and the POC fails to give every date, but I assume 4 invoices

Your VRM details and password are still on show, so incorrectly redacted, deficient

I hope that you did the AOS online stage on MCOL. ?

I’m guessing not much can be done without the claim No.? I have done the AOS online already to give me more time to respond. It can be difficult to navigate this forum to dind the defence template. Also to make it relevant to my case

Really? I can never understand the difficulty. A forum is like a book, where threads like yours are pages/chapters, and the Announcement threads pinned on page 1 at the top are the front cover.

I think the confusion comes from the amount of links, granted it’s easy to navigate when going to each subject. Also only just released that the template is below the comments section.

I think my main argument is the verbal agreement I have had since September 2018 (my evidence being the WhatsApp messages) being that this agreement overrides the terms of standard parking signage. Also that I was not informed of the change of management….

I will probably submit over the weekend, rather do it sooner rather than later

Yes, plus the fact the POC fails to plead 4 specified dates (this is important).

Put it something like this, as I advised:

Your para 3 of defence must mention that the POC fails to stage four dates but the vehicle was always authorised, due to an alternative contract for exemption, a longstanding verbal agreement with one of the stores.
