  • I would continue with sickness absence for as long as possible and let them make the decision on capacity dismissal should it come down the line. A friend has went down this route a while back, it takes a while but every day that you are still employed is another day of financial benefit. Don't rush things, I am sure you don't need the additional stress - and don't be forced into resigning because it suits them.

    im at the end of the line with sickness absence, next week is d-day, going for ill health retirement via occupational health dept with council via the hr dept, thus getting my enhanced early retirement pension.

    Yes and No

    dismissal on Capability ( health) grounds is a fairly standard consideration when someone has been off sick for over a year and there is no timeframe for a return.

    There is only so long the employer can gap the role especially if there is no provbision in budgets / staffign models for covering sickness ( rather than Mat Leave where there are often provisions for an organisation to employ a fixed term employee)

    Suppose that all depends on company. We have people that have been off sick for several years. They will not remove them. All it is costing company is their pension payment & of course these people will not voluntary leave due to the pension payment.

    Reason behind it is that they do not want any bad press. 🤷‍♀️

    Im in the process of ill health retirement with my employer the local council right now, occupational health will ring me shortly and ask if iv had a diagnosis for parkinsons yet, i don't see the neurologist till next month, my dilemma is i cannot say iv had a diagnosis yet, and that goes back to hr dept and then eventually to an irmp, but iv not had a diagnosis yet which would effect getting an enhanced lgps pension… time scales messed up, employer wants me gone.. understandable, i want to go as well, comes down to i do not not have a diagnosis yet and things are processing with hr dept occupational health dept, i cant give them a diagnosis yet, oh and im not being paid anymore by them, it's ran out, getting esa at the moment, and doctors fit notes.
