PCN Notice to Keeper

Hi

My husband received a PCN notice to keeper from Civil Enforcement.

I was driving the car at the time taking my daughter to a medical appointment. I waited in the car while she attended the appointment as the letter stated she was not to bring anyone with her to the appointment.

I just didn't notice that you had to enter your vehicle registration on the screen inside the medical centre in order to avoid a parking fine. (I discovered this only after I received the PCN as I drove back to the centre to check). On arrival I just followed the signs for patient parking, parked the car and waited for my daughter to finish her appointment. (35 minutes)

I have looked at the newbies thread. I have tried Plan A but the medical centre said they cannot do anything.

I have looked at the appeal process online on the Civil Enforcement website but there is nothing suitable from the drop down list as to why I am appealing. Also it is asking for the keeper and driver details

I was going to go to Plan B but I cannot find the email address of civil enforcement to send the template to.

Any help would be appreciated.

    You can’t technically appeal as the PCN is in your husband’s name. You can assist him though

    Can you post a redacted copy of the NTK. Keep the date of issue and incident on show

    Don’t admit to CEL who was driving yet.

    Why did the medical centre not help? Who did you speak to? You need to complain to the Practice Manager

    General rule:

    DO NOT APPEAL AS DRIVER.

    The keeper appeals unless he would fold and would not be robust enough to play poker face and defend their doomed claim, later.

    Or he transfers liability to you now and you can ignore it and laugh.

    The pseudo 'appeal' won't work because POPLA are not fully independent and will say the signs were there.

    So I wouldn't bother with second stage appeal and concentrate instead on deciding which of you will be the defendant to see this daft thing off until it gets discontinued next year, when they give up.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

    Thank you for your reply - yes I will assist him.

    I spoke to the receptionist and she said there was nothing she could do. She said people who appeal usually get the fine reduced to £20.

    Will send an email to the Practice Manager today.

    (I have never been to this centre before so was not familiar with the parking system).

    Why We Introduced the Parking System

    We understand that parking can sometimes feel stressful, and we truly appreciate your patience.  Our system was introduced to solve some very real issues.  Patients were experiencing difficulty parking for appointments, cars struggled to exit at certain times of the day and, most importantly, emergency vehicles needed reliable access to our site.

    Free Parking for Appointments

    If you have an appointment with us or with Berrycroft Dental, parking remains free during your visit, providing vehicle details are correctly entered on the touch-screen devices provided before leaving the health centre.  Car parking for the general public is not permitted.

    Double-Check Your Vehicle Registration

    Please make sure the full and correct registration number is entered.  For example we are advised that sometimes the number '0' is entered instead of the letter 'O' (and vice versa).  Entering an incorrect registration will lead to a Parking Charge Notice (PCN).  A quick check can help avoid any unnecessary issues later.

    If You Receive a PCN

    If you do receive a PCN, please follow the instructions on the document if you wish to appeal.  We understand this can be frustrating but unfortunately, we are unable to act on your behalf.  Doing so would take time away from supporting patient care and might also affect your appeal process.

    Clear Information and Signage

    The terms and conditions set by Creative Care Parks, who operate our car parking system 24 hours/day, are displayed in our car park.  You will also find multiple banners and posters around the building as parking reminders.

    We truly appreciate your understanding and cooperation.  This system was put in place to keep our site safe and accessible for everyone - patients, visitors and emergency services alike.

    Dropping off patients or prescriptions

    Our car parking system includes a ten-minute grace period for dropping off a patient or prescription.  This grace period begins when you enter the car park and ends when you leave, allowing you to do so safely.

    For those with multiple appointments requiring a longer stay, our system accommodates extended parking as long as those attending our health centre have registered their vehicle details.

    Creative Car Parks Terms and Conditions

    If you breach any of these terms you will be liable for a parking charge of up to £100.

    Additional costs and debt recovery charges will apply if the parking charge is not paid with 28 days.

    These parking terms are enforced at all times.

    Blue badge holders are not exempt from these terms.

    We use ANPR, CCTV, and manual patrols to monitor this private property. We may contact the DVLA to request the registered keepers details to issue a parking charge notice (PCN).

    The fact that they get so many confirms that the system doesn’t work from a patient’s point of view.

    The practice should have the ability to get invoices cancelled (they aren’t fines)

    Why should someone have to read a website if using the car park?

    10 mins waiting for dropping someone off and then waiting for them isn’t sufficient.

    It's all very well for the Health Centre to state that they cannot help but they seem to have forgotten that you didn't enter the centre because they had specifically advised your daughter NOT to take anyone in with her. How else were you or anyone supposed to know about a keypad?

    As you have been fobbed off by the Practice Manager you could try the Integrated Care Board for the area;

    This is the equivalent of the PALS service found in hospitals - GPs and other NHS facilities have to be covered by PALS but not so easy to locate where they are to be found. I am not sure you will get anywhere but I don't think the centre can acknowledge there is an issue and just wash their hands of problems.

    I would also suggest you check the signage in the car park as their website says T & Cs are clearly displayed in car park.

    I have contacted the practice manager and if that fails I will contact the integrated care board as suggested.

    Can't see much on Google Streetview but the signage appears to be the usual essay in small print on a high up sign.

    How is this requirement to register communicated?

    A big clear sign obviously makes less money, and the health centre will just let CE do what they want as they are paying for their signs as part of the "service".
