How to call off the CCJ guys
Hello all, I've looked up previous threads about this and I KNOW it is a much-discussed topic, so apologies for starting a new thread which appears to drive some people mad! But I can't find anything that is exactly like my case, and so I'm unsure what to do here.
For one, the fine in question is valid. I've checked the dates and I definitely didn't buy a ticket that day. Lots of the threads I've read are about scams / fake fines, which this is not. I just never received the original fine. The first I heard of it was when the debt recovery guys wrote to me.
Secondly, my address with both DVLA and car are both up to date, and I have received other fines at this address (I am not a regular breaker of rules! Just forget from time to time).
So my question is - I've tried to message and call the debt recovery team to tell them I never got the original fine (which I guess would be £50 or so). They insist there's nothing they can do (because, of course). I've tried to contact NCP but they insist there's nothing they can do now that it's been handed to the debt recovery team.
I see lots of advice about ignoring the debt recovery letters, but surely I do need to pay the original fine, if I can get NCP to reissue it? How do I do that?
I also saw the contact details for the DVLA to complain, but is that relevant in this case?
As an aside, when I contacted NCP, they told me there is a second fine on the system which has also been passed to the debt recovery team! But I haven't had any letters about that one at all.

Its definitely NOT a fine, they are just outstanding invoices for the alleged breach of the parking contract on private property
Ignore debt recovery firms, they are powerless without a court order
You dont appear to have any CCJs, so no bailiffs will call
I dont think that you have good grounds for DVLA complaint, so probably irrelevant
NCP are currently in administration, so that fact may help you in the future
The NCP charge was more likely to be £100 , not £50
You cannot stop the various letters
Ignore them and wait for an LBC or court claim

Thanks! Oh that's interesting about administration, I hadn't seen that story.
I'm not worried about bailiffs, just about the debt escalating. If I wait for a court claim, surely that will add costs, and I don't really have any grounds to defend myself as I did park without paying the fee. I don't see how I can prove that I didn't receive a letter from NCP, as you can't prove a negative. That's the bit I'm not clear on - sorry! Do you mind explaining?
I'd really like to just pay the NCP costs and get rid of the whole sorry affair. Thanks again in advance …

No you wouldn't. You won't be paying.

NCP being in administration means they can't start new court claims.
Even if they weren't, of course a court claim DOESN'T add costs because nobody pays, they just defend then twiddle their thumbs until DCB Legsl discontinue, as is their MO.
