Blue badge parking

Good morning all , Happy Easter ,

I'm hoping that you can help me with a query , I parked in a parking bay on a public street today , the parking spot was clearly marked with a white box and a single yellow line, no markers regarding loading only , taxis etc , I parked there just after 1800 ( it's difficult to see on the dial , however it's rotated to just after 6) , parking on the road is free after 1800, I have a blue badge which entitles me to park on a yellow line for 3 hrs .

The council meter clearly states " no charges for badge holders"

I returned at 2100 to see that I had a ticket , the reason was " no ticket displayed " , it also said that the car had been observed from 2059 until 2100 so literally one minute ! .

Is this a valid ticket ?

I wasn't dropping off or picking up ? .

The issues I have are that parking after 1800 is free , I'll admit that I was parked on a yellow line , however it was under 3 hrs and I'm assuming that in closer inspection that the wardens images will prove that , also shouldn't there be a grace period? , hanging around a disabled persons car waiting for the clock to tick over doesn't seem right

Any advice would be appreciated, Thank you

The bit at the very top of the sign means no waiting between 7.30pm and 8 am. You can't park there in the evening because it's no waiting and no loading at that time

As we major on private parking tickets here, Free Traffic Legal Advice (FTLA) forum will be your best bet for council penalty charges. Register there but please note that a Hotmail address may not work - try using a throwaway Gmail account instead if you do have trouble registering, and post a new thread; here's your link:

    https://www.ftla.uk/index.php?board=3.0

Read the sticky 'Read this first before posting your case' as well as reading through some of the other threads there ahead of posting your own details, to get the hang of what information they need from you in your opening post - but as a minimum you will need to post redacted photos/scans of all correspondence you've received from the council (both sides, if appropriate), as they need to see all the small print, and a Google Street View link.

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

The problem is you parked when there are 'Loading Restrictions' in force you may park for up to three hours except during hours when there is a ban on loading as shown on the sign.

I think you are on a sticky one here, but you can try FTLA they are the experts on authority issued tickets this forum is mainly for private parking charges.

Yes, it's a quirk where blue badge holders cannot park during loading restricted times.

So it's no loading after 7.30pm and therefore no blue badge parking after 7.30pm either.

    However, the contravention seems wrong.

In my opinion it should be

    • "02 - Parked or loading/unloading in a restricted street where waiting and loading/unloading restrictions are in force - higher level - £70"

You didn't park during parking hours and failed to display a ticket.

I would try appealing under "the contravention did not occur" and tell them the contravention that you admit to is 02, but that your contravention did not occur as it was outside pay and display hours.

What's the code of your contravention?
