New Build in Scotland Disputes with Builder
Hi All,
We bought a new build in May 2024 and we our windows and doors have not been water tight throughout the two years. The two years will end on may 2nd 2026. The builder has been out over 20 times and cannot fix the issue, its causing damage to our property. We have lodged this via NHBC and complained officially to Builder. I also had to sue my whole annual leave last year to allow the builder in to try and fix.
Is there anything we can do legally - i.e. breach of contact?
Any advice would be appreciated.

NHBC should help you, but they aren’t the most amenable tbh

Do you have legal cover on your home insurance?
You will probably have to get an independent report on what needs doing. Might be a good idea anyway, otherwise they will just bodge it.

'phone local solicitors and ask if they specialise in this sort of case. Then engage best sounding company.
Or do it yourself if you are legally trained in this area......
