Euro Parking Services - Issue
Hello, I've posted here before with an issue and they haven't replied to me in a very long time… However, there has since been a new case…
My partner received this fine in the post.
I went online on the 18th day to appeal it with the PoFA 2012 challenge - but it told me that I was out of time and had to pay it… I was confused by the writing in the letter vs the writing online - The letter states "within 28 days, starting from the second working day after that on which the notice was given" and the website states "appeal within the 28 day period from the point of issue of the Notice to Keeper"
I appealed for more time - Below and their response below that.
I would like to add, that the car was not parked in a bay - it was parked 3/4 on the path, and about 1/4 towards their property (Similar place as the red car, but closer to Abbies Pets and Exotics, again, below.
Also, this is the signage on the premises…
Any thoughts/opinions on the matter would be great, their response clearly states they think they could win this in court, But I haven't even had chance to bring up about the PoFA 2012 bit yet…

Put in another complaint that they have:
- not provided details of ADR or independent appeal, and
- not provided evidence that the car was parked, as opposed to moving, and
- not provided evidence that the driver's attention was drawn to terms (no entrance sign) and
- not provided evidence that the driver's attention was drawn to the CCTV surveillance or how the captured data would be used (GDPR and DPA 2018 breach) and
- not provided a certificate of posting for the NTK, yet
- admitted to posting NTKs second class, which means the NTK wasn't deemed served until the second week in February. This means the appeal was easily in time according to the NTK wording which promises that a recipient can appeal: "
within 28 days, starting from the second working day after that on which the notice was given".
