DCB Legal Court Claim 3 Parking Charges

Situation:

I responded to an LoC and now I have received a claim form.

The issue date on the claim form is 30/03/2026. So I believe 5 days (or is it 7 days?) from this date I will do an AoS via MCOL.

Claimant: Secure Parking Solutions LTD

PoC:

Defendant

Particulars of Claim

  1. The Defendant (D) is indebted to the Claimant (C) for 3 Parking Charges (PC)s issued to vehicle [redacted].
  2. The dates of contravention are between 25/09/2025 & 07/10/2025.
  3. The Defendant is pursued as the driver of the vehicle for breach of the terms on the signs (the contract). Reason: Unauthorised Vehicle.
  4. In the alternative the Defendant is pursued as the keeper pursuant to POFA 2012, Schedule 4.

AND THE CLAIMANT CLAIMS

  1. £510.00 being the total of the PC(s) and damages.
  2. Interest at a rate of 8.00% per annum pursuant to s.69 of the County Courts Act 1984 from the date hereof at a daily rate of £0.08 until judgment or sooner payment.
  3. Costs and court fees.

My analysis: I was not the driver of the vehicle for any of these charges. All 3 Parking charges were detected via remote camera. No windscreen notice for any of them. The Ntk for all 3 chargers were sent separately, and well beyond the 14 days from the date of contravention for each incident.

Therefore my defence will be as keeper and I believe they have no basis to make me pay as keeper.

    Name the claimant

You can do the AOS online over the weekend, ideally by Tuesday if you prefer that 5 day margin

I'm going to guess Smart Parking? If yes, search the forum for the Smart Parking group defence thread and copy that.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We have seen a few SPS DCB LEGAL claims on here over the last 9 months, study some of those and use the latest defence template

If Secure Parking Solutions sent non-POFA NTKs you can adapt the Smart Parking defence para 3 from that group thread. Already written about the POFA.

You can also add that the POC fails to state the three dates alleged.

    I have a question.

I was charged 4 times. The first time I was charged and sent a NtK (Contravention date: 22/09/2025) I paid this straightaway for £60 at the time as I was not aware I could fight it.

Then I received NtK for a separate charge (contravention date 25/09/2025) and a few more after this.

Now I just had a look, but two of these charges (25/09/2025 and 07/10/2025) I have the NtK and they are sent after 14 days from the date of the original incident.

The other date 07/10/2025, I can’t find the NtK. DCB legal replied to my LoC email earlier this year.

Their reply included documents that they had sent through the posts. There was no NtK for the date (07/10/2025 incident) just final reminder letters.

I’m thinking of emailing them, to ask for that NtK.

Also because I paid the very first charge that I was sent, could they use that against me to pay for the 3 that occurred after?

Not relevant at this time, think about all of that after the claim is transferred to your local civil court, before the WS stage

Do not ask for evidence at this early stage, don't request paperwork, no SAR either

Just follow our advice above, using the template defence with a few changes

With an issue date of 30/03/26 and providing you complete(d) the AoS after 04/04/26 and before or on 18/04/26 your defence deadline date is 4.00 p.m. on 05/05/26

I Just found the NtK for the 07/10/2025. I can confirm all Ntk’s have been sent after 14 days have passed from the date of contravention.

This should be a simple defence as keeper I reckon.
