UKCPS Permit Not Displayed - Debt Recovery Firm saying i'm going to court if i dont pay?Help/Advice?

Hi Guys,

I've had a read around a few threads and can see a lot of similarities with other cases but no direct match with my situation so making a new thread for advice.

Received a letter from UKCPS saying permit wasn't displayed with photos of my car with no permit displayed, it must have fallen down the side of the car as i've been paying and displaying it for months prior. I submitted an appeal right away and explained then heard nothing further.

Checked emails regularly and no calls/letters. Then I receive a letter about 2 months later from debt recovery company Trace who I then called and asked what is going on, i received no word from UKCPS on my appeal. Trace said they rejected my appeal and sent a request for more evidence in terms of the permit. I asked to see a copy of this as I had never received this and trace sent over a pdf document of a letter making this request for me to submit further documentation to UKCPS within 14 days, and stating they have rejected my appeal.

I told trace I never received this letter, they never sent me an email they never phoned and there is no proof this letter was ever posted. Trace guy was fairly useless, I sent all my evidence to Trace as soon as i had sight of this letter but obviously, they would not refer it on to UKCPS (I understand this isn't their job) I asked if I could dispute my claim with anyone from UKCPS and I was directed to their legal team. Moorside Legal. I called them today and was told as I didn't respond to the appeal rejection there's nothing I can do and I have to pay, they ensured me UKCPS would've contacted me by email as I appealed online, this was not the case and again I said I never received an email.

I asked for all correspondence, a DSAR request basically and he said he will get that to me but they will continue proceeding against me.

The fine is £170 now which is what they are asking me to pay. I genuinely believe this process has been made deliberately obscure. My permit slipped down, I concede that but then it should be a very simple process of demonstrating I do actually pay for my parking spot and own a permit and then the appeal is accepted. The process should be in place for people who don't pay.

At a loss for what to do here, do I just pay it? They're saying it will proceed to court and I could be liable for costs or CCJ etc? The threats are working and making me nervous about what to do, any advice whatsoever is appreciated even if its just to pay.

This whole process feels exploitative. Thank you in advance all and for reading.

    Ignore them and wait for a Letter of Claim ( LBC ) or a court claim against you and then come back to this thread

    Do not pay ? Just ignore, for now

    Yep. It's how they operate! Did you realise:

    • Trace and Moorside are in the same group (APN) so nobody really passed the case to a separate solicitor 'legal team'!
    • The Trace chap wasn't 'useless' because his whole job is to scare you into paying money. As is the job of the other kiddie (probably sitting at the next desk in the call centre) who spoke 'for' Moorside! They aren't there to fairly resolve cases and help consumers.

    Stop taking the bait and phoning this motley crew up. First rule at this stage of the game is IGNORE THE DEBT CRAWLERS.

    You actually WANT the Claim form because that's the 'end game' and you'll pay nothing.

    PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
