Hello

need some advice my partner parked what they thought as not blocking access to the persons driveway. But has been issued with a PCN, pics were taken which show the vehicle is not preventing access to the driveway, but I want to know, should we appeal it and if yes, on what grounds?

Thanks

As this is a council matter i strongly suggest that you post your query over on the FTLA parking forum website after reading their posting requirements first. That is where the council experts are

When a homeowners pays for a dropped kerb, they pay for the sloping sections as well as the middle flat section, so all of it is part of the dropped kerb IMHO

Had there been a white I bar on the road, it would have been across all of what was paid for

The sloping part IS part of the dropped kerb

Thanks all, yes I get that

I will post on there, see what/if I can do anything, or if I simply pay it!

Out of interest, how was the Beamer in front of you expected to get out?

Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.

Not for PCN issuance it isn't, unless there has been a new key case decision since I was on pepipoo a few years ago?

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

^ and actually, also a matter of other people's behaviour that you don't control. This happens to me all the time as my drive is flanked on both sides by free parking in one of the only unrestricted streets close to 6 different schools. My ability to access the drive depends on three cars' positions: the two either side of our drive and the one opposite, all on a road that narrows considerably as it reaches our house. People rarely take into account the angle of exit.

We are frequently blocked into our drive because someone 'tucks their car in', overhanging the slope and often part of the full kerb cut, with an assessment that they are not blocking access because, visually, they guesstimate that our car could fit in the gap left. Then the person on the other side moves, and is replaced by someone who parks right up to the cut. Or a super-wide vehicle parks directly opposite, so there is no turning angle between the three parked cars. Or any/all of the three cars is left 2 foot away from the kerb, further reducing the exit angle —as is the case in your photos!

So - whether you're successful in your appeal or not, could you heed my appeal to gently educate your partner on being a little more considerate in the future?!

(S/he clearly knew it was borderline since they apparently took a bunch of photos after parking…)
