    Hello again, thank you for all your help. Is this enough for my defence or should i include this as para 3 of the entire defence template:

    I am not the registered keeper, and I was not driving the car when this PC was issued.  The event/location referred to is in Scotland and as such, the POFA 2012 Act does not apply: The keeper cannot be harassed or held liable, nor can your client assume that a keeper was the driver.

    Euro Car Parks Ltd must cancel and erase my data, as I am not the liable party.

    Further, a counterclaim for harassment, abuse of process, and data abuse (as per Simon Clay v Civil Enforcement Ltd and similar successful cases) is likely to follow if I continue to be pursued for this claim.

    A defence is written in the 3rd person, so edit it accordingly

    If you are neither the registered keeper, nor the driver, how come the claim is being made against you?

    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
