Euro Car Parks NTK Chelmsford

Hi everyone.

Wondered if this has happened to anyone before and whether appeal was successful!

I parked in The meadows retail park Chelmsford and entered the multi story through the Euro Car Parks entrance. It appears that the floors of the car park are owned/managed by different companies.

The ground floor is managed by ECP and floors 1-5 belong to Chelmsford council.

I used the machine by entrance door to pay for a ticket and the machine couldn’t find my reg from the ANPR camera and said to drive to the exit and leave.

So I did, then I get the NTK. It seems that the machine I used is for the council floors 1-5 (same parking house) and not an ECP ticket machine. I took a photo of the screen that advised to drive to the exit and leave, so I have actually attempted to pay but used the wrong machine. There was no signage advising that the machine was ONLY for council parking.

Do I have grounds for appeal? Has anyone done the same?

    Its actually a common mistake with shared car parks

    I cannot see any grounds for appeal, but that doesn't mean that you should pay ECP !

    Why bother to appeal?

    Nobody pays Euro Car Parks invoices all the time that the industry is unregulated.

    Read a few dozen links in @Umkomaas' DCB Legal discontinuances thread to understand why you don't pay.

    NB: that is not to say 'don't pay to park' which is absolutely not this forum's message.

    I have read all the newbie thread, and was going to follow the process suggested starting with the appeal.

    I have studied the POFA wording and it seems now that ECP’s NTK is POFA compliant with changes to their wording.

    I have read and understand DCB will eventually discontinue with the case if I hold out long enough, however the signage is inadequate at the location and wonder whether it’s actually worth using time and appealing this as step 1. Is it a waste of my time to submit an appeal based on inadequate signage?

    The blue appeal template in the Newbies thread says an explanation of the allegation and photos of the vehicle are required. However, these are included on the NTK as standard so it seems ECP have changed their NTK probably based on the number of appeals using that template. Even though the thread says the template is still relevant I don’t see how it can be?
