Smart Parking

Hello Newbie here, I'm hoping that someone can give me some advice please.

I attended a wedding (son's) at a hotel in Stratford upon Avon at a hotel without a customer car park just a small permit holders one with a small loading area.

To access this area you drive through a public paying car park.

2 of us had to park elsewhere as this car park was full.

At the end of the evening we drove through this car park to access the side of the hotel to pack stuff into our cars.

We both got PCN's for not paying for parking in the car park that we drove through,we were clocked at 11 and 12 mins.

The charge is from Smart Parking which is not the company named as the operator.

We appealed the parking charge which has now been rejected but will appeal to IAS but imagine this is a waste of time.

The hotel have also emailed Smart Parking telling them that we were customers but obviously this has made no difference.

The car is registered to my wife but I was the driver,is it to late to tell them this as I want to go to court because I fail to see how anyone with any common sense wouldn't dismiss this case and she doesn't as she is bothered about getting some sort of record.

I have added some photos showing the entrance to where we stopped to load and the car park sign.

    Yes she can name the driver anytime up to a court claim being issued

    Don't bother with the IAS stage

    Do not pay ,

    P, she cannot get a record for a civil court claim

    It might seem a daft question but how will I know when a court claim is going to be issued to tell them who the driver is?

    The registered keeper should receive a letter before/of claim giving "30 days to pay or legal action will be taken"

    It would be too late if she waits for a Claim. She can obviously transfer liability now if she really wants. Every PCN explains this on the back. It's very simple but no idea why she would?

    Not sure what sort of record she is envisaging! Nobody pays Smart Parking invoices and nobody here risks a CCJ either. Nobody goes to a hearing because they always discontinue then.

    Literally NO RISK by following our advice.
