Refusal to replace
Hi all,
We're building a house and a shower door arrived damaged.
The company is refusing to replace it as it's over two weeks since they delivered.
The delay in noticing the damaged item is because our builders only just got to the stage of installing it. It was kept in it's packaging in the meantime.
Do I have any consumer rights to request again that they replace it or is it tough luck for me that it wasn't spotted in the company's stated timeframe?

Within 30 days, any issues are presumed to be the fault of the retailer and the item can be rejected for a replacement/repair/refund. Thats the consumer rights act 2015, which overrides anything the retailer might have written in their policies.

Did you buy it yourself directly from the company? Did your builder buy it or you order through his trade account?
Consumers have very generous statutory rights but businesses have almost none.

No worries, been here long enough to see many repeat problems… buying through a trade account, particularly the likes of kitchens from Howdens, is a repeated problem because people think they are the buyer but as its their joiners account legally their business is the buyer so no consumer rights from Howdens but you do have rights against the joiner.

Within 6 months, but if specifically rejecting within first 30 days reverse burden of proof doesn’t apply.

Thanks all for your help, I relayed that back to the company and while they are absolutely unable to go against their company policy, on this occasion they will as a gesture of goodwill replace the item 😂
