Car park fine because payment app applied wrong parking rate

    I'm sorry I don't understand. The letter I've received matches the POFA letter which two exceptions (text about freezing payment on appeal and some further information QR codes). This is the letter I've received.

    Hi Dukeotto,

    I think the point to understand is: Yes, the NTK is a POFA one. But that does not mean that you treat it with any respect. You still appeal, using the template as per the Newbies thread. You could add a paragraph about "frustration of contract" - the app they ask you to use charged the wrong amount. In all sentences, do not use "I, me" etc, use "the driver".

    Most importantly, please understand that NCP have gone into administration,, so these orphan tickets will not be pursued correctly, the administrators will not know how, or be able to pay for POPLA appeals to progress.

    As do almost all NTKs. Some 95% do. I was simply looking for the very easy 'out' that a non-POFA one gives keepers.

    It doesn't make it legitimate or payable!

    It's also NCP. Come on… that company is in administration! Do you think they have staff to fight POPLA appeals? Nope.

    Do you think they are allowed by the administrators to spend the POPLA fee it would cost them?

    No. NCP can't contest cases at POPLA and we've seen that already. So do the 2 stage appeal and they must give up.

    Also in your post title you call this a "fine" it isn't it's just a speculative invoice, the whole appeals system paperwork etc used by this scammers industry is contrived to make the public fall in to a trap by copying as near as they can authority Penalty Charge Notices, even using Parking Charge Notices to describe their invoices.

    Notice in that NTK they say: "parking was recorded by an approved ANPR camera" there is no "approved" ANPR camera in the private parking industry, they use what ever equipment they like there are no standards approvals, or legislation covering the equipment, in fact local authorities are prohibited from using ANPR in off street parking situations.
