New DCB Legal claim

Hi all, I recently received court claim forms from DCB Legal (on behalf of Parking Eye) for a parking ticket received in May 2022. I have submitted my AOS and currently in the process of drafting my defence using the template defence and other threads on here, and I will post this up when it's complete along with full details of the claim. My defence will be based on the fact I was informed via email prior to visiting the site that "parking permits are suspended", and there was no mention of payment.

A quick question I have for now - I moved house several months ago so the court claim only arrived at my current address as my mail is being redirected. I updated my driving licence and VO5 details in August with the new address so they obviously haven't checked recently to make sure they have my correct address. Ideally I don't want to extend my mail redirection which is due to expire soon but certainly don't want to miss any more letters so who do I need to contact to make sure the relevant people have my correct address?

    Pretty sure if you now change your profile address on your Govt Gateway account it will overwrite the address and the court service will see that as your address.

    Also send an email to the CNBC and cc in DCB Legal telling them to ERASE the old address (use that word and restate the correct new address for service).

    To make certain also update your MCOL account

    To amend your address details, go to your MCOL homepage and click on the link to ‘Edit Registered Details’ at the top-right corner of the page.

    Thanks both, I've checked and my MCOL account is showing as the correct address. I've made sure Govt Gateway (via HMRC account as it directed me there) is showing as correct too. I will email DCB Legal and CNBC too and post up the full claim details tomorrow.

    Question re. my defence: DCB Legal are acting on behalf of Parking Eye Ltd, but I'm a bit confused by this part in the template thread: "You may decide to use and adapt as your own, the Defence wording suggested in the post below... unless you have a CEL (in-house only), Elms Legal, Gladstones or a Moorside Legal claim without the alleged breach/reason specified (and also specifically for DCB Legal claims for ParkingEye or Group Nexus / CP Plus) in which case, you can use this wording as paragraph 3, re CEL v Chan and CPMS v Akande, here: https://forums.moneysavingexpert.com/discussion/comment/81571257/#Comment_81571257"

    In the PoC, they have stated the alleged breach as follows:

    "Vehicle remained on private property in breach of the displayed T&Cs."

    Do I go ahead and use the alternative paragraph 3 as written in Minimonsta's linked thread, despite the fact that the PoC does indeed state the breach?

    And if so at which point/if any do I set out the particulars of my own situation, i.e. that I had been informed parking permits were suspended and therefore there couldn't have been a breach?

    In the PoC, they have stated the alleged breach as follows:

    "Vehicle remained on private property in breach of the displayed T&Cs."

    What is the particular breach? From what they have written in the POC, anyone would be hard pressed to find it!

    As Above, the actual alleged breach is not pleaded, so use the Chan and Akande defence

    No they haven't. This is exactly the same as all other DCB Legal ParkingEye claims.

    I'm with you all now, thank you. I've attached the redacted PoC but I'm assuming based on the above there's no need to include any specific info about my case.

    Some other info about the claim in case relevant:

    Original letters were sent in June 2022 to an address which I had moved out of three years prior and so by the time they reached me (I was still loosely connected with the residents of that house) it was well past any appeals stage. I don't think I had any letters after about December 2022 until they started again in late 2025 (going to another old address and redirected). All letters I have state the exact same reason for the charge as worded above, though one does provide more info in a different paragraph stating that the charge was given due to there being no permit or payment in place.

    Also, is there any need or benefit for me to declare who was driving?

    Stick to the generic template defence including Chan & Akande ( stop overthinking this early stage. )
