2 DCB Legal Letters - Scotland

Hi all,

I have received 2 letters from DCB Legal in relation to private parking tickets, to my name - as the keeper of the vehicle.

I have not replied to any previous letters nor declared the driver of the vehicle at any point.

I am in Scotland and both parking incidents were in Scotland.

one is on behalf of ParkingEye and one UK Parking Control Limited.

I have read other threads as this felt more serious than the other letters, however it seems when in Scotland the most current advice is still to ignore?

I have already missed the “14 day window” they give you to respond due to a busy month anyway so I am only just getting round to it.

My main questions I am hoping for assistance on are:

  1. Is the best advice still to ignore at this stage, especially given there are 2 letters - including fake fees - totalling £340?
  2. What will be the next step if they do not just let it go, will it be from a Scottish Solicitor - albeit I understand this is rare?
  3. I am willing to continue fighting these however risk to reward is seemingly slimming as my main definite, are I do not want the stress of having to attend court and I do not want to even toy with the chance of getting a decree, is there still plenty of time before this to prevent that happening?

If context of the parking is useful then please let me know, but seemingly whether people were in the wrong or not the advice is still to contest these.

For one of them I literally are in the restaurant and just didn’t sign in on the iPad because it was at the hotel reception, not the restaurant and no staff mentioned parking.

I will attempt to attach photos of the letters with my details redacted as I know this may be useful, it seems their wording has improved from previous threads.

Thank you all.

    1 correct, IGNORE THEM

2 correct, ( or a sheriff letter, or both. )

3 the deadline in Scotland is 5 years from the incident 4th

  • thank you, so if I did receive a sherif letter or solicitor letter, what would be my next steps?

also, is it possible that I can receive a decree as the next step or are there many more steps before that’s even possible? Same question for having to attend court as well? I really do want to avoid these possibilities.

I can't really give you legal advice, just Consumer advice

I suggest that you try the Scottish Law Centres or websites regarding the simple procedures track

You may find a couple of threads on here over the last 14 years where the Sheriff system was involved due to cases in Scotland but as you said yourself, they are very rare

What you want is at odds with what they want, anyone can take court action to recover an unpaid outstanding Invoice

But plan A in the newbies sticky thread in announcements applies in each and every case throughout the UK, in all 4 nations

  • Understandable, I’m just trying to weigh up if it’s possible that I would be required to attend court and or get a decree from this current stage and if so, whether that would change my decision.

I will have a look at your recommendations.

    Thanks again.

Maybe research the Carlie Macky case from years ago, the legal basics may be there

Ps, plenty of information if you Google simple procedures Scotland

Just google Simple Procedure Scotland and find results telling you how it works.

    But NOTHING WILL HAPPEN.

They do not litigate in Scotland.

    IGNORE.

PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
