Charge on property.

If someone lends someone else money, and has it secured on their property, where does this show up?

This was prob around £100k, and arranged correctly using a solicitor. The loan was used by the homeowner to invest in a property business.

Nothing in the title deeds afaIk.

    If it hasn't changed recently, it's the Land Charges Registry. This shows all mortgages and other things secured on property. Search for this online for details.

    Assuming the lending was to the person rather than their company then a properly registered interest would be on the land registry. There is more than one way in which it can be registered however depending on the finer details and this does assume the lender actually bothered to register it.

    Now't to do with me - a completely third party.

    My apologies - having just had sight of the TDs myself - a 'summary' - the charge is mentioned. What isn't is the sum. Where can I find this (and hopefully not costing the person another £14…)

    It's unlikely you can "find" the sum anywhere if you're not one of the parties. If it were a normal mortgage, the balance of your mortgage account is between you and the bank, nobody else.

    If the charge has been registered as a legal charge you can apply by post for a copy of the charge itself -

    Get information about property and land: Get a copy of the deeds - GOV.UK

    However the legal charge will only confirm the original secured information for example for £100K and at what interest. We won't have any information re what's still owed for example and as posted such details are only going to be held by the creditor/lender and debtor/borrower

    That's been done, and the charge is mentioned, but not the original sum.

    What I've seen is a 3-page 'Summary of Title', for which I understand £7 was paid. Should the whole Title Deeds be obtainable for this? And would that include the original sum?

    There's no particular reason why it would include the original sum, it's more common these days (for "normal" mortgages anyway) for them just to refer to "all sums due and to become due".

    You are referring to the register itself. The actual charge should be on file and that would normally contain the original sum secured. Otherwise the application form submitted at the time should refer.

    You need to apply for the actual charge or mortgage deed document. This should contain details of the advance and repayment terms.
