Cabot and Mortimer Clarke THREAD CLOSED
Hi all,
Not a great day today as I've had letter from Resolvecall AND Cabot on the same day. Not a nice feeling at all.
My letter from Cabot states that one of my accounts has been passed to Mortimer Clarke Solicitors. What does this mean and what could the potential outcome be?

It is just being shuffled about, all you can do is wait and see what you receive next.
If you go down to the woods today you better not go alone.2 -
Yeah, I seem to recall a similar letter from Kearns Solicitors as it happens who passed it back to the "servitor". Thank you. Just thought I would ask you guys. :)

Mortimer Clarke act as a debt collector, but are also Cabot`s legal arm.
Unsure what strategy you`re adopting, but non engagement with MC can result in a court claim, so read well anything they send you.

Hi. So the letter is from Cabot to expect contact from MC in 7 days. I haven't received anything as yet.
I certainly will respond to MC though.0 -
A formal Letter Before Claim is the thing to look out for. If you get one, post again.

I don't like the sound of that at all. 😐️Ok, will do. Thank you.

Last year you said your disposable income was quite low and could not afford to service all of your debts, is that still the case?
If so, that`s the kind of thing you should tell Mortimer Clarke to avoid them taking further action.
Worst case scenario, they issue a claim, your response will include an income/expenditure form, so they will be able to see what you can pay, if it did result in a CCJ, payments are set using that form, a court won`t set a payment that is unaffordable, these kind of bulk claims are all done online and by post, you don`t normally attend an actual court, if a CCJ isn`t detrimental to your work, its not a big deal to be fair, its just a way of securing payment, even if that payment is £1 a month.
As I say, that`s the worst case scenario, hopefully you are blessed with the gift of the gab and can avoid such unpleasantries.

I am at the beginning of my DMP journey but one thing I have picked up is that once the debt has defaulted it is best to contact them to let them know how much you can afford and start to make payments if you want to avoid the ccj etc route. Good luck.

Our situation financially has not changed and if anything, is set to get worse as bills keep rising, food prices have doubled. Every single outgoing has risen. Just had my car insurance renewal and that has risen by almost £500. The cost of living is getting a little ridiculous.
A CCJ for me personally would mean I could no longer act as a director for my business so yeah, it would be an extremely negative thing.
In addition to that, a CCJ would also affect us all as a family as it would impede us from ever switching our mortgage to a better deal in the future.
We are currently on sub-prime mortgage which is costing a small fortune per month.
I do not draw an income from my business, I literally pay the bills and that's it and keep the business running.0 -
I have sent an SoA to all of them in previous letters so they are aware of my current financial situation.
I just hope that they will see the reality of our situation and be gentle with us.0
