    HardWaiter...

Management aren't required to "prove" they only need to show they had reasonable belief to act.

Do nothing atm and await further communication from them, likely to say the investigation has concluded and you return to work or an invite to disciplinary. There are occasions where you may have a further Investigatory interview to provide further details or clarify an issue.

    Good luck.

Maybe its just a unison thing but they told me they can't help with any case that happened before I joined. Making them somewhat useless.

It would be like taking out insurance after your house has burnt down and expecting the company to pay out!

That said, some unions will still offer general advice to new members (but not fighting the case for them) and occasionally make an exception if the issue of direct relevance to the wider membership.

If you genuinely believe that to be the case then maybe ask to speak to a more senior individual in the union.

It's a standard Trade Union thing

same as you cannot get insurance after the incident.

you are supposed to join, contribute and take an active part in being part of your union BEFORE you need individual support … the best time to join the relevant union for a job is the day you start the job

I've been a member of 4 different unions in my time , each relevant to the employment sector / employer in question. I have been an Accredited Representative and a Health and Safety Representative for at least one of them

I would suggest (hope) you are using the paid time off to search for a new job

Sorry to say but your old job will never be the same again and companies will often take action which removes the likelihood of any future accusations/problems (sadly, it’s usually weighted against the accused)

With under 2 years service- I have to say, I don’t think you will be returning to work there.

Did you get the result? If they find in your favour I would be putting in a formal complaint against this person for making false allegations.

It's possible that this person made the allegation because you got promoted and they didn't, given you started at the same time. Hopefully HR will have some common sense.

Regardless, I would be looking for a job elsewhere as I wouldn't want to work with someone who goes round making allegations like that.

Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')

No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)

    Is there an update?

We have update, after 2 interviews with HR and finding a solicitor that has assisted me, the HR removed my suspension as the fact does not happen as proved by my colleagues and friends. Also at the moment i'm back on duty with my same position as per promotion, and i'm waiting for a mediation table that for sure she will not accept. in case I'm going to send a letter from my solicitor through the HR to her. My request is the end of contract for her, all the legal expenses refunded, plus all the money lost for my not pervenued holiday (yes was holiday time for us) and all the damage to my person and my family.
