CCJ Applied for over parking ticket
Hi all,
Sorry - I know there is some info in the forum on this but I'm struggling to figure out quite what's best to do.
Around 6 months ago I attended the cinema with a disabled adult I sometimes care for. I parked in a disabled bay but, in a rush, I forgot to display the blue badge. The car park is free.
I had received a ticket for parking in a disabled bay without the blue badge. When I emailed to explain the situation, providing photos of the blue badge, they rejected my appeal. I heard no more and actually forgot about it, in all honesty.
This week I've received notice that a CCJ has been applied for and that I'm now being ordered to pay £257.88 - for parking in a disabled bay in a free car park, just because I'd forgotten to display my blue badge. I do not want to pay, I think it is scandalous that they'd do this, but also I obviously don't want a CCJ and so am tempted to pay.
What is the best course of action for me at this stage, please? I am terrible at admin and this is not my strength, engaging in this kind of stuff, so I want to get it right.

You have not got a CCJ.
The company cannot "apply" for a CCJ, they can issue a claim and if undefended or they win the case, if you then don't pay - they can get one.
- Read the newbies thread.
- ask the cinema to get the PPC to cancel the PCN
- Make sure you respond to the claim form when it arrives.

Nobody has applied for a CCJ but you MUST DEFEND THE CLAIM IN TIME.
Show us the Claim Form with your data, VRM, claim no. and password redacted.
Tell us the Date of Issue top right. Of the Claim Form, not Moorside's daft letter!
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
CLICK at the top or bottom of any page where it says:

So I have 'defended' it - I went online and I told them I intend to appeal, which apparently buys me another 14 days. So I know that I am in time - it's just a question of what I do now!?

You can't appeal against a N1SDT claim form, presumably what you mean is that you completed the Acceptance of Service (AoS) and said you intend to defend the claim. This does indeed buy you more time. If you tell us the date of issue of the claim form we can give you the deadline for defence, which is the next thing you have to do and it can be done using MCOL and the template defence incorporating your own paragraph #3. If you don't tell us the date of issue, use this advice to calculate your deadline: -
You must send or submit either the completed acknowledgment of service form or a defence to the court within 14 days of the date of service. If you send or submit the acknowledgment of service you must send or submit a defence to the court to arrive no later than 28 days from the date of service. Date of service is five days after date of issue.

Also can you post the redacted claim form as previously requested by C-m.
