POPLA Appeal NCP
Hi, I wondered if I might be able to get some assistance with appealing a PCN. I have contested the PCN with NCP directly and was advised "our records show the notice was correctly issued as your vehicle was parked in breach of the Terms and Conditions of Parking". I have been advised by NCP in line with their ATA membership they are required to provide me with an Independent Appeals Service and can do so with POPLA.
The circumstances surrounding the PCN are as follows. I attended a NCP car park and parked my vehicle within a bay. The reason for the PCN as outlined by NCP was "parked outside bay markings and liability for the same having been brought to the attention of the driver by clear signage in and around the car park at the time of parking".
The car park itself demonstrated unclear bay markings with various different overlapping bays due to conflicting painted lines on the ground. The evidence I was provided by NCP shows this clearly. My grounds for appeal are ambiguous bay markings and unclear signage (see pictures attached).
Any advice on what to include in the POPLA appeal would be massively appreciated.

Yeah well they've gone into administration so nothing will happen! But NCP are still trading at the moment so you may as well cost them a POPLA fee and see how it goes.
You'll never pay this invoice anyway.

I would say that is excellent parking, unlike some of the "parked out of a bay" photos we see on here. You are bang between the lines and smack on the centre "T" marking. If the PPC wanted you to park differently they should have managed the car park by repainting the lines. Of course they don't actually manage the car park, they just manage the issuance of PCNs!

I wonder if NCP will start to lose staff at a rate of knots and soon won't contest POPLA appeals?

Well, I believe you might be right in saying they unlikely to contest POPLA appeals @Coupon-mad as they have withdrawn. Just received this email from POPLA!
"The operator has contacted us and told us that they have withdrawn your appeal.
If you have already paid your parking charge, this is the reason your appeal will have been withdrawn. Unfortunately, you cannot pay your parking charge and appeal, which means that POPLA’s involvement in your appeal has ended. You will not be able to request a refund of the amount paid in order to resubmit your appeal to us.
If you have not paid your parking charge, the operator has reviewed your appeal and chosen to cancel the parking charge. As the operator has withdrawn your appeal, POPLA’s involvement has now ended and you do not need to take any further action.

Everyone with an NCP PCN should appeal then take it to POPLA.

Will the adninistrators run with the current scam ? VERY DOUBTFUL
For the Administrators, they have a problem ….. do they use the mega scam industrry (BPA APPROVED) which involves idiotic debt collectors and Mickey Mouse legals who want to line their pockets with monopoly money ?
Of course they could use REAL legals at what costs, real legals do not want to know with the rubbish
Will the Admistrator waste a lot money after taking their fees on total crap as approved by the BPA
It's not just parking firms who must be in the eyes of the CMA, it must be the ATA's who allow the scam
