Thank you for your patience, if it wasn't obvious(!) this is the first time I've dealt with anything of this nature and your support is invaluable!

    Redacted Claim Form:

    IMG_1380.jpeg

"Mac Court" is not a description of a location. No town, no postcode! But then you live there so you know it anyway.

    Background from your first post:

The ticket is for my car, parked in my space (which I own). The freehold of the property (building and carpark) is owned by the Management Company formed by all of the flat owners, of which I was, at the time, the sole director. Despite all of this, UK Parking Patrol refuse to cancel a ticket from the one day my pass dropped off the windscreen.

    Did you ever appeal?

Show us UKPPO's notice to keeper, both sides, if you kept it.

Why ON EARTH did the RTM group get a thug parking firm in? Remove them asap! You don't need a permit scheme. Get rid. Ridiculous to let them in.

The day to day management was handled by a management company, they changed the parking company without consulting us. Previously we had a friendly bunch who I would speak with like actual human beings and ensure they were working with residents best interests in mind. I cancelled plenty of tickets when residents family etc got caught out - honestly, that's probably why I was so naive about this one! You would've thought UKPPO might've reconsidered bullying the one person with the authority to get them booted off site, but apparently not.

I'll see if I can dig out the Notice to Keeper, but we've moved since then...

    Trimmed down Defence to follow.

Just 2 & 3 as the remainder is as per the (very much appreciated) Template, now considerably more concise!

    2. The allegation(s) are vague and liability is denied for the sum claimed, or at all. The delay in bringing proceedings lies with the Claimant, making retrieving material evidence difficult, which is highly prejudicial. The Defendant has little knowledge of events, save as set out below and to confirm that they were the registered keeper.

    3. The Defendant denies the allegation of a 'failure to obtain authorisation and/or display a valid permit'.

3.1. The Defendant is granted authority to park by the Terms of the Lease and the express permission of the Freeholder of the property. This authority may not be altered by any third party.

3.2. The Defendant denies any contract was entered into between the Defendant and UKPPO.

    Good. Just change:

3.2. The Defendant denies any contract was entered into between the Defendant and UKPPO.

    To

3.2. The Defendant denies any contract was entered into between an unknown driver of this vehicle and the Claimants, who are put to strict proof of their allegations and full POFA Schedule 4 compliance if relying on 'keeper liability' which is not an automatic right.

Thanks again, really do appreciate you taking your time to help!

Hopefully my last question for a few weeks... I'm just about to email the Defence and I think I should CC in BW Legal - is that correct?

They refuse to provide an email address, so that's not an option. I think I will mention that in the body of the email.

I see you have no choice but to email the defence:

there is a bar placed on the claim which I don't understand. I have submitted the Acknowledgement of Service via email as per the instructions of the Court, as MCOL wasn't recognising my Claim number. Apparently it just doesn't sometimes (how helpful).

Make sure the subject line includes:

URGENT UNPROCESSED DEFENCE - MCOL BLOCKED - CLAIM NO XXXXXX

Headings at the top including the claim number and both parties' full names (not BW Legal and don't copy them in).

And headed with the word DEFENCE.

Make sure the D has signed & dated it under a statement of truth (the defence is a PDF: you are not using any form and the defence cannot be copied into the body of an email).
