Parkmaven Parking Charge Appeal - What to do next?
Hello Everyone, so just a bit of background. This is my third parking charge from ParkMaven for parking in the same place. I never knew the space was private land as signage is not clear at all, but after receiving my first pcn I stopped parking there of course, then the second came and I paid that as well (I parked in the same place three times in a about the space of less than two weeks, that’s why I got charged two more times after). However, the third and final charge, on the pcn letter it says event date is: 17/12/2025, but issued date is 23/02/2026 and I received the letter to my home address on the 27/02/2026. I appealed two things, first that due to Protection of freedoms act 2012, this comes after 14 days so shouldn’t be liable and stupidly the second thing I said was that I am not the registered keeper when I am. I should have said I am not the driver, don’t know why I didn’t say that. Also, when I go on their site to check my original appeals message that I sent, it says ‘we are unable to show this parking charge, please contact us’ so I have sent them a message today asking for it as I want to check exactly what I wrote, but have no hopes of them replying with their history! They also replied back to appeals decision today completely ignoring the POFA 2012 and decided to focus on the fact I said I’m not keeper and they want evidence of this to remove the charge. Please can someone help me? Thank you so much! ** I’ve attached screenshots of all relevant docs**

Firstly, it sounds like you admit (on here) that you were driving but that you have told them you were not. Is that correct?
Secondly, yes, provided that you are the keeper, and your details are up to date, and there wasn't a windscreen ticket, then the Notice appears to be out of time.
They will inevitably reject the appeal, but POPLA should (hopefully, but not guaranteed) knock it on the head.
Oh, and don't name the driver.
I would appeal as follows:
Paragraph 9(4) of Schedule 4 of POFA requires that, where the notice is sent by post, it is DELIVERED (not just sent) within the relevant period.
Paragraph 9(5) of Schedule 4 of POFA provides that the relevant period for delivery is 14 days, beginning with the day after the parking event.
The alleged parking event was 17/12/2025. Taking 18/12/2025 as the first day, that means 31/12/2025 is the 14th day - i.e. the last day on which the Notice could be DELIVERED and meet the requirement of Paragraph 9(4).
The notice is dated 23/02/2026. This is, in any event, outside the 14 day period. The notice is deemed to be delivered (unless the contrary is proved) on the second working day after posting.
The 1st working day after posting is 24/02/2026. The second working day after posting is 25/02/2026.
It is therefore deemed to have been delivered on 25/02/2026, which is after 31/12/2025 and therefore outside the permitted 14-day period for DELIVERY.
The Notice to Keeper was therefore not DELIVERED in accordance with paragraph 9(4) of POFA and therefore the right of recovery under paragraph 4(1) of Schedule 4 of POFA does not apply.

Hey! Yeah that’s correct, I saw online that you should never confess to being the keeper so I just did that out of panic, but mentioned the POFA act. Yes I am the keeper and all my details are up to date and there was nothing on the car.

Have you just confused keeper and driver again? 😅
The advice is to not name the driver - it's not to go one step further and deny being the driver if that isn't the case! You can simply say you're not required to name the driver and will be appealing as the keeper.
Please can you come back once your POPLA appeal has been decided so we can update the megathread of POPLA decisions?

I mentioned in my appeal that I wasn’t the keeper that’s all, I didn’t mention anything about who the driver is. I kept it brief and just focused on the latter with the POFA. And yes of course, I’ll let you know of the outcome :) thanks again

sorry just one last question before I submit the POPLA appeal, I should just stick to the POFA act argument right? Since I messed up first time with the parkmaven appeal by saying I’m not the keeper, so it’s best to not bring that up in the POPLA one? Many thanks! :)
