G24/DCB Claim Form

Just as I am dealing with my own predatory PCN my Dad sends me a picture of a claim form from Oct 2024. He has no recollection of the event and can't remember receiving any NTKs etc (he may have at the time then threw them away, certainly hasn't received anything relating to this in the last few months).

I have looked at many G24/DCB examples and found some with the Reason: "Unauthorised Parking At. (whatever that means?!) and have put together the following paragraphs, Para 3 I have tried to include a few things I have seen, hopefully it is still ok:

2. The facts in this defence come from the Defendant's own knowledge and honest belief. Conversely, the Claimant sets out a cut-and-paste incoherent and sparse statement of case. The POC appear to be in breach of CPR 16.4, 16PD3 and 16PD7, and fail to "state all facts necessary for the purpose of formulating a complete cause of action". The Defendant is unable, on the basis of the POC, to understand with certainty what case, allegation(s) and what heads of cost are being pursued, making it difficult to respond. However, the vehicle is recognised and it is admitted that the Defendant was the registered keeper, but due to the amount of time that has passed from the alleged date of contravention the Defendant is unable to confirm who was driving the vehicle at the time.

3.     Referring to the POC: paragraph 1 is denied. The Defendant is not indebted to the Claimant. Paragraph 2 is denied. The Defendant does not accept that a contravention occurred on 29/10/2024, as alleged. Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Claimant is put to strict proof that the driver was 'unauthorised' and that a contract was extended to 'unauthorised vehicles'. The Defendant avers that such a term is prohibitive and offers nothing of value, thus the elements of a contract cannot have existed. Adding 8% interest to inflate the claim by a huge sum as a reward for their own year of inaction is unjust enrichment, and the delay has prejudiced the Defendant who genuinely has no idea what this is about. The Defendant cannot recall this incident, so the Claimants are put to strict proof of all their allegations, keeper liability, signage and authorisation from the landowner.

    Paragraph 3 seems overly long, I think that the last half can be deleted but wait for other replies

    Doesn't really matter either way as this will be discontinued. I'd just shorten it a smidge so it will fit within the character count.

    Thanks, unfortunately its not my first rodeo 🤠 - Noted re the length of Para 3 - will wait for other replies as to which parts are best to remove, I did feel I tried to put too much in from other good examples.

    Then Dad can twiddle his thumbs until they discontinue, following the first 8 steps.

    Apologies if it is written somewhere but I looked and couldn't find anything:

    When should I receive the Directions Questionnaire? I submitted my defence and MCOL notes it has been received on 25/03/2026.

    I haven't heard anything from the claimant and I haven't received a Directions Questionnaire. Does it typically take a while?

    It takes a while, correct, no real timeframe, so keep checking your MCOL claim history, assume 2 or 3 months after the defence submission date
