The small number of legals who play around with pocket money and they all think the same, that the ATA code of practice is a law ?

As a members club, the BPAcode of practice was set up to benefit parking companies. The £70 is just a scam known as the OSNER SCAM .

Again BWL are ignoring the Supreme court ruling …. judges of course are fully aware of the Supreme court ruling and will see the fake £70 is just a scam and extortion

Does the sign show very clearly the word contractual or is it hidden away in the small print

Helping others on here, I have been in court on 3 Britannia/BWL cases where they added a fake £70. All 3 cases were dismissed by the judges

It is a form of Double Recovery which the courts do not allow. A BIG TRY-ON

I havent studied in detail yet the signs, I will when I need to make WS. I have just google mapped it to see the signs and locations, so cant really tell

Update:

Had the mediation. Went something like this:

I offered £5, they offered £200, I offered £10, they offered £150, I offered £20, they maintained £150 and wouldnty go any lower.

Basically, it was a seafront car park, which has 24hrs a day 7 days a week charges. Ity was late at night last year when I parked and I didnt realise I had to pay.

On the gate as you go in above the height restrictions is a large sign saying 24HRS A DAY PARKING CHARGES. I didnt see it as was focussing on what is in front of me, and not above the large gate.

I have dispurted that I didnt not see the signs or pay machines and that teh signage was inadequate. Am I fighting a lost cause here?

Never a lost cause but they'll put those evidence photos in their WS bundle and there will be a hearing. And the judge WILL definitely start by looking at the signage evidence.

Your case doesn't sound the strongest … which is why on page 1 of this thread (unusually) I suggested you offer up to £100 at mediation in your case:

"Britannia Parking through BW legal. I parked in a car park and did not pay, as I thought after a certain time it was free. It was late in the evening. The car park apparently has 24hours a day car parking and it serves local shops, restaurants, and leisure facilities and you have to pay no matter what time it is."

Show us the signage evidence or go back on foot in darkness after 10pm and get evidence pics of unlit signs.

You'll need that for your own WS. See post 2 of the NEWBIES thread; read the section everyone overlooks(!) about WS and exhibits stage. You need to build evidence because telling the judge "I assumed it was free that time of night" isn't a defence.
