Car insurance database showing as an open claim still active
Long story short everyone
Someone crashed into me.
I fought my case strongly for almost a year. Car now repaired in October.
Lost 9+ NCD down to 3. Got all my points reinstated £500 compensation numerous apologies. Still sending me messages saying money has been paid into my account from a claim update no money received not bothered by that as I wasn't expecting anything further from them.
Main concern... partner wanted to add me as a named driver as it reduced policy renewal. Spoke to his new insurance provider who said proof of NCD is not acceptable as there is still an ongoing claim open. Iv had it up to my eyeballs with my old insurers nothing but trouble and incompetence on another level.
I am still in 2 minds to go to ombudsman as iv dealt with this for over a year crash happened a year ago to this week. Iv had to fight for what was right.
Should I do a SAR direct with my previous insurance company and also a SAR through CUE database to get a file and a case started. I was forced into a 50 50 because I hit deadlock status. I had to do all tje work. Was told my case was at 5k on phone halfway through the year I said what for youve sent 1 letter and iv had to call them so many times. I think they paid out to the other side without my permission or admission before the 50/50 was forced. Can I get all that information from a SAR?

It is unusual to be asked for NCD to add a driver.
Is the claim still open? Maybe the other parties 50% costs haven't been concluded.
They don't need your permission to make payments.

If it's a 50/50 settlement then they will be dealing with the claim from the third party. The claim can only be closed once they are confident that all aspects of the claim is completed. If the third party claimed for injuries that can go on for years depending on the severity.
I echo others, why are they asking for the NCD for a ND? that makes no sense and have never heard anyone doing so. Now if they asked to add you they will have been asked to give your driving history and claims history. That could cause a problem if they declared it as a non-fault accident but they see on CUE or another exchange that the claim is still open, most will consider an open claim a fault claim.
Insurers have the legal right to settle claims how they see fit, they dont need your consent to go 50/50. Most will try and get it, some may resort to ultimately telling you if you arent being reasonable etc. One or two I know won't go against a customer's wishes but you have to agree to indemnify them for the delta caused by resisting a 50/50 but then coming out of court with a worse position.
