PCN - Code 27 - Barnet Council
Hi All,
I received a PCN from Barnet Council for contravention code 27: 27: Parked in a special enforcement area adjacent to a footway,
cycle track or verge lowered to meet the level of the carriageway
See images below, where I believe I was not parked on the below slope of the pathway? Unless I am missing something.
I had already tried to appeal this by stating what I said above and this was their response:
We have carefully considered your challenge and decided not to cancel your PCN.
The Civil Enforcement Officer (CEO) observed your vehicle parked adjacent to a
dropped footway. The Traffic Management Act 2004 allows for enforcement action
(issue of a Penalty Charge Notice - PCN) to be taken when a vehicle is parked
adjacent to a dropped footway. This covers any dropped footway including those
which assist pedestrians crossing the road as well as cyclists to join/exit the
carriageway and supported by photographic evidence. Furthermore, there is clear
indication by Tactile paving (also called truncated domes, detectable warnings,
Tactile Ground Surface Indicators, detectable warning surfaces) that there is a clear
pedestrian usage, especially to the visually impaired. As a tactile pavement/ramp is a
system of textured ground surface indicator found on footpaths, stairs and train
station platforms to assist pedestrians who are blind or visually impaired.
On this occasion we have decided to give you the opportunity to make payment at
the discounted amount of £80.00 within 14 days of the date of service of this letter. If
you decide not to take up this offer, please see below ‘What happens next’.
Should I go ahead and pay this fine or should I hold this out and do I have a chance at winning this?

Since we concentrate on parking charge notices from unregulated private parking companies, you would be better off taking this over to our friends on https://ftla.uk (the forum started to replace Pepipoo), as they are the experts on council and police issues.
You will need register before reading the FAQs, then posting both sides of your PCN with your query.

If your wheel was not adjacent to the fully dropped kerbstones, then the contravention did not occur. The CEO is trying his or her luck by the looks of that!
