APCOA Parking Charge

Hi all,

New here and looking for advice. The company I work for have received the attached (redacted) notice. I was the driver at the time. I managed to stop them just in time so nothing has been paid, and they haven't contacted anyone to advise who the driver was at the time.

As you will see from the notice, I believe I should be able to fight this as the time and date of entry and exit are identical to the second, although the pictures show me supposedly entering during day light and leaving during darkness. In the picture apparently showing me leaving in darkness it's impossible to see anything, let alone make out a number plate.

I also notice that under how to appeal, it states that a notice to driver was affixed to the window, this was not the case. Therefore I had no ability to appeal, as I was unaware I had received a parking notice.

I will do my own research through the various posts this evening when I get time. And hopefully I'll be able to figure out for myself exactly what the process I need to take should be to achieve a successful appeal. In the meantime if anyone can point me in the right direction to relevant posts that I can read this evening, it would be much appreciated.

I am posting here for assistance but also for my own records in case I experience some difficulty, and then hopefully I can ask for more assistance if then need arises.

    Get the company to name you as hirer to APCOA, because its currently in their company name, or similar

    Once you receive the NtH in the post, appeal as hirer based on the failure to comply with Pofa2012, no hirer liability

    Their Pictures are of the actual vehicle, not the driver ( not of you. )

    I wouldn't get them to name you. I'd do an appeal as the company because that is already a Notice to Hirer.

    Use the company version of the two Edna_Basher examples in the NEWBIES thread. The company then wins because a company can't have been driving.
