Company car SMARTPARKING NTK

Hi all

I did some research on this one but I'm just coming up blank so I'm asking.

I have my own LTD company and I got a NTK for overstaying free parking from Smart Parking. It's addressed to my company. It looks POFA compliant it's within 14 days unfortunately and looks like all the right wording.

What's the best way to go about it?

So far the best I can think off is telling them I've hired it from my company and they will send me a NTH addressed to my personal address and hope they don't send the agreement and that's an instant appeal.

Any ideas how to go about it?

It doesn't have anything that relates to my situation, except for "appeal as per advice above".

I haven't got a notice to hirer. I only got a notice to keeper to my company so I can't use the absence of hire agreement as an appeal.

What I'm asking is if I should try to appeal from my company (I can't see any grounds for appeal bc it looks POFA compliant) or if I should name my personal self as a hirer and then wait for a NTH?

That's my question ultimately because I can't see any grounds to appeal.

(Yes I tried the landowner they told me to go do one)

Ok thanks I'm building a picture of the next steps.

From what I've gathered, the best course of action is to contact Smart Parking and give them my personal details as lessee.

Then deal with the hopefully incompliant NTH.

I wouldn't bother because there is no appeal worth trying with an IPC AOS member.

I would let it go to court claim this year, where they always discontinue. Much easier!

    Thanks

    1. Is it not worthwhile sending off the 3 docs required by para 13 so they send me a personal NTH hopefully without the docs? (I might do it anyway to get it off the company as my business partner is nervous about it 😁)
    2. Do smartparking always go to court claim?

    Thanks couponmad!

    1. Yes you can.
    2. Yes, since 2025 they are going for it in a big way, getting DCB Legal to plough though their £1.2 million 'debt book'.
