I haven't had a single bit of communication so far with G24 or DCB. In hindsight both the PCN's would have arrived after the 14 day period due to postage delays as I said, the 23rd December ticket was 'issued' on the 14th day, the law presumes letters/post arrives on the 2nd working day, which would have been 8th January, making the 2 PCN's arrive 16/21 days after they happened.

From your experience, is this my strongest claim to get this cancelled? If I make this my primary reasoning, do they have a right to demand I inform them who the driver was?

Might be a silly question, but the number of posts on here is overwhelming! Am I looking for paragraph 3 on post 2 of the newbies thread? @Gr1pr

I will get the AOS completed today. I couldn't yesterday due to the MCOL website not loading all evening. Then I'll write up my defence.

You need to read and understand the court claim advice in post 2 in the newbies sticky thread in announcements, then after completing the AOS online on MCOL you adapt the template defence by coupon mad after studying the 1st 2 posts in the defence template thread in announcements

Your defence is based on the POC and uses the template defence

As above, the newbies thread is the place to get all the right info. For POFA the pcns are assumed to have arrived 2 business days after issue, so if that puts them outside the 14 day window they are not compliant and liability cant be transferred to the keeper.

Which you then put as your bespoke paragraph 3 into the Template Defence (which is - like the Newbies thread - pinned at the top of this forum).

Or you could just search this board for Smart Parking defence group thread and adapt the para 3 there, which is already written to cover the fact a PCN is non-POFA.

Just wanted to post an update, ever since this post, the moneyclaim.gov.uk website has been down. I have tried to get online every morning, afternoon, and evening and not once has it been online! Does anyone know why this is?

I still haven't completed my AOS, as I was under the impression it's better to complete online than by post so I've been holding out.

My issue is that the claim form was issued to me on 27th Feb, which means the 14th day falls tomorrow (13th March). Does that mean I have only tomorrow to get the AOS complete, or is there an extension due to website downtime?

The claim form says, 'You must send either the completed acknowledgement of service form or a defence form to the court within 14 days of the date of service. If you send the acknowledgement of service, you must send a defence to the court to arrive no later than 28 days from the date of service'.

Issued on 27th Feb gives you 19 days to do the AOS stage online, meaning the 18th March

Try a different browser because its not down

    There are NO extensions

It's working now, thanks. Used the 'welcome' link above and worked on the first try.
