Parking Charge - Britannia Parking

Hi,

Can't believe I'm back here with another PCN to Keeper this time from Britannia Parking.

I just have a quick question:

This is for a carpark in Glastonbury where we bought a ticket from a machine but were approx 1/2hr late returning to the car.

My question though relates to the timing on receipt of this PCN.

The date of contravention was 17/02/26

The date of issue of the notice is 23/02/26

However, I have only just received this in the post today 4/3/26; this is later than the 14 day window from the date of contravention but I have no real proof of this as the envelope is not date stamped.

It would be my word against theirs but do I have any recourse on this at all?

    I have a quick question please before I appeal this PCN having just received a final reminder.

    I can't visit the car park as it is 2hrs away unfortunately.

    We paid with a credit card and so it shows a payment to Britannia on the date, so there is a proof of payment.

    We also have the original purchased ticket.

    We paid for 3hrs but were over time by 29 mins.

    The actual PCN simply shows the time the car entered the carpark and the time it exited. It doesn't show anywhere that we exceeded our ticket at all. It simply says:

    " As the motorist has contravened the terms and conditions detailed on the signage, a Parking Charge has been issued."

    Is this sufficient or are they meant to detail the minutes we have exceeded the ticket by?

    I wouldn't bother to appeal. Better to ignore it and defend a claim (as long as you don't go moving house without telling them).

    Hi,I did actually appeal…I told them that there is proof of purchasing a ticket ( which we do have). Rather than submit it as evidence though I put the onus on them as from the original PCN it looks as if they have clocked the car arriving and leaving but not that we bought/ exceeded a ticket as they simply say :

    " As the motorist has contravened the terms and conditions detailed on the signage, a Parking Charge has been issued."

    They don't say HOW!

    They have now come back to me with the attached response to my appeal which is worded strangely as they haven't directly asked for the evidence of the purchased ticket but it is clearly IMPLIED that this is what they are requesting.

    My question is…..if they have initially issued this PCN on the basis of NO payment for car parking but we then submit evidence of payment can they then continue with this PCN on the basis of the fact that we exceeded the ticket by 29 mins?

    Part of me wants to say - I have the evidence that we have purchased a ticket and have no intention of submitting it until we get to court!

    Any advice here would be appreciated.

    Frankly, I agree with the advice given by coupon mad in the post above , let them issue a court claim against you and defend it, no point playing ping pong. !

    ( they can do whatever they want to, its currently an unregulated industry, cowboy country. )

    Hi, Just an update on this…

    My appeal to Britannia was unsuccessful (no surprise!) The latest response does cite for the first time the specific reason for the PCN - the overstay of the ticket. It says they allow a 10 minute grace period. The overstay was 29 mins.

    I have read the NEWBIES post thoroughly but am having brain overload at the moment so would appreciate some confirmation / clarification that I am doing the right thing here please.

    I take it from your previous posts that there is no point in appealing to POPLA and I just wait now for the LOC?

    I don't feel I have much of an argument so am slightly nervous as to how I might go forward with trying to present evidence?

    • I cannot find the landowner of this carpark to complain to despite searching ( Silver St , Glastonbury)
    • The photos Britannia have supplied as evidence are pretty clear and show the £100 fine in large letters. I cannot visit the carpark to see what other signage there was unfortunately so it's difficult to argue a case of unclear signage.

    I'm slightly confused as to what else I could argue here apart from a £60 ( going to £100 ) fine being disproportionate!

    Your thoughts would be greatly appreciated.

    The disproportionate argument disappeared 11 years ago with the Beavis case at the Supreme Court

    There are various monetary punishments that are £100, or more, especially in London or mobile phone usage when driving, its an unregulated industry but the £100 figure has been the usual highest charge for well over a decade for private parking company invoices

    I would still pay them £5 via the app for an imaginary stay. Then you can truthfully state you paid the full amount and covered their admin when you defend.

    At least then any court claim would be "they paid late" as opposed to "they didn't pay".
