    In your opinion -

No, not in my opinion. It's the opinion of the Financial Conduct Authority. As I mentioned, they set out rules and guidance in their ‘Insurance: Conduct of Business Sourcebook’ (ICOBS’).

Their opinion is quite important - far more so than mine and even of insurers because they regulate these things and rule on any disputes.

Of course they might change their opinion. But for the moment that is what adjudicators rely on.

…the principle that an insurer can't decline a claim due to breach of a policy term that is not relevant to the actual loss is also firmly written into statute law, specifically the Insurance Act 2015

It's also touched on, specifically relating to motor insurance, in the Road Traffic Act, s148:

    Road Traffic Act 1988

Can we get back to the real problem - getting our "checkatrade" friends off the road and therefore stopping vulnerable members of society getting ripped off?

That would involve much more investment in the Police. The few we have prioritise "important" crimes that don't directly affect the majority of the population. There just aren't the resources to chase rogue traders, burglars, car thieves, uninsured drivers, vandals, scammers etc.

I want to go back to The Olden Days, when every single thing that I can think of was better.....
