BPM parking and slightly confused
Hi all,
A work friend of mine received a Notice to Keeper from BPM parking, the driver, but not the keeper, stupidly parking in a disabled bay for about 12 minutes on a "dark and rainy" night. I have had words!
I wonder if someone could help me identify any issues with Keeper Liability/POFA on this one? The whole thing is written by some semi literate fool. Even more disturbing is the threatening liable to prosecution "declaration of truth" ,just in case you wanted to transfer liability to the driver.
This is a strange one. Photos of the incident on the payment section of the BPM web page abound, but all of the car parked and some photos suggestive of a notice to driver (close ups of the wind screen etc), yet no notice to driver shown or received and the send out time is indicative of an ANPR ticket. They seek to confuse.
This site is a big footprint for a non-entity like BPM but I'm sure some POFA fails would fit nicely in your keeper liability section, just in case the beast grows!

…who the heck are these new kids on the block with a 'PCN' that has grammatical errors and typos and fails to offer the mandatory 40% minimum discount?
It says the discounted sum is £70 but that isn't allowed. But don't tip them off on that in the first appeal. Save that for IAS stage because this surely will see BPM fold.
The keeper should just use the template appeal.
Then do IAS, quoting the Joint Code clause on the 40% minimum discount.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

As I am sure does the BPA with their (slightly different wording) DVLA MoU.
