This won't answer the consumer rights angle, but considering things pragmatically resale via an appropriate online market place might even generate a profit.

It went a bit silent, however it is clear that mentioning the relevant legislation, and pointing out the presence of returns information and a label in the package has done the trick.
I can have a refund.
