Proving Source of Funds
I hope this is the correct place to post.
My son is experiencing difficulties in proving the source of funds for the deposit on his first house.
He was left an inheritance when he was 4 years old. This was held in trust until he was 18 when it transferred to his name i 2016.
He is now 27.
The Solicitors are insisting he finds the original Trustee documents to prove that the original source was an inheritance ( anti-money laundering checks!).
Nobody we can find had any original documents since the trust was wound up when the youngest beneficiary became 18 ( in 2018). The financial advisors who ran the trust have moved on and / or retired. The original Trustees do not have any paperwork since they destroyed it once they no longer had any responsibility for the trust ( they are also very old and could not really do anything).
How can we get around this?
The original legacy was about £30k and had grown into over £100k which is being used as a deposit for a house purchase.
thank you

Can you get a copy of the original will to at least show he was left money in trust?

Can you ask if the solicitors would accept a statutory declaration?

"Insisting" as in your son has told them the documents aren't available, but the solicitors are still saying they can't touch the funds and won't accept him falling back on anything else? If so then the only solution is to find a more sensible firm of solicitors.

I've never heard of a statutory declaration adding much to proof of funds.

thanks
We have now a copy of the original will which shows his name as a beneficiary ( albeit through a Trust). Hoping that will work.

There would never have been any trust documents this was a simple a bare trust created by the will. I think his solicitor is being way over the top here, so maybe time to find an alternative solicitor.
