Eligibility of Applicants
Me again. So, I’m trying to get through to the probate help lone. Very long wait time. Trying to help my niece sort out her Mum’s will. Briefly, there is a will, both executors have died and one of the beneficiaries is under 18 years old. I know that two applicants are required, but the PA1p says contact HMCTS to ascertain who is eligible to apply. Anyone help with eligibility? Thanks

Is your niece married or in a civil partnership?

Does your niece have siblings?
Does her mother have other siblings?
If you're the closest living relative (or you can demonstrate that no-one closer is able to act) I can't see how there can be a problem.

My niece is married and has a brother. Her and her brother are specifically mentioned as beneficiaries. The juvenile beneficiary is not mentioned by name, but as the child of my niece’s other brother who died a few years ago. My deceased sister-in-law also has two surviving sisters and two surviving brothers.

Well the obvious choice would be her brother.
