UKPA PCN - Scotland

My wife has just received a PCN from UKPA. We're in Scotland, proceeding to follow plan A with a landowner appeal, but I also wanted to check that advice in Scotland is still to ignore everything up to any court documents?

But you will get keeper liability when the statutory Code of Practice and regulatory regime is in place.

Just reading through the defence sticky (in anticipation), and I was wondering if the standard defence is applicable in Scotland, if things get that far?

Also as an ANPR car park, is there any avenue to claim there's no proof of parking - the photos only show entry and exit and conceivably the driver could have just driven around for 20 minutes and then left….

Given that the redress process is different in Scotland, i would suggest that the England and Wales system would not feature in a Scottish case, different strokes for different folks , so NO

Its still time on site, so the driver is bound by the site rules on the signage, whilst on the land a contract

You will not get a claim in Scotland (obviously laws aren't retrospective) and no, the usual defence may not fully apply in cases where a rare PPC tries (VCS and SABA did but only in one or two cherry picked high value multi PCN cases 'pour encourager les autres').
