    I agree. Contacting the DVLA is not necessary. Just defend the claim in your full name. It doesn't affect the case.

    Thank you @Coupon-mad and @Gr1pr for putting my mind at ease. You've all been fantastic to me and I'm so grateful.

    I'm in the process of writing my defence. I still can’t get my head around how they expect me to defend when I don't even have the photographic evidence.

    I'm using the template (thank you again @Coupon-mad !) but if anyone knows of a recent defence similiar to my case that I could get some ideas on how to word paragraph 3, I'd really appreciate the point in the right direction.

    I'll make sure to post a draft here.

    With an issue date of 14/04/26 and providing you complete(d) the AoS after 19/04/26 and before or on 03/05/26 your defence deadline date is 4.00 p.m. on 18/05/26

    Defence questions:

    Paragraph 2 -
    I was the registered keeper at the time but as I’ve ignored BW Legal from the start, they have no idea who the actual driver was. In their Particulars of Claim they put: “Not parked within a marked bay. D is liable as driver, or keeper per Sch. 4 PoFA 2012.”

    So I just left it as “The Defendant has little recollection of events, save as set out below, and admits that they were the registered keeper.

    Is that the best way to handle it or should I phrase it differently?

    Paragraph 3 -
    The POC on my claim form is all merged into one big paragraph with no clear breaks. How should I refer to or differentiate between the different points/sentences?

    Paragraph 2, you are ok to leave it as you say above

    Just adapt the example paragraph 3 i linked to suit your own case and details, then post your proposed paragraph 3 below for feedback, avoiding breaks

    Your paragraph #2 should be "……….. registered keeper but not the driver." IF true

    Your paragraph #3 needs to refute the POC, i.e. not parked within a marked bay.

    Ok so I've rejigged the paragraph @Gr1pr kindly recommended to match the order of my POC.

    Paragraph 3 for feedback:

    3. Referring to the POC: paragraph 1 is denied. The Defendant is not indebted to the Claimant and does not accept that a contravention occurred on __/__/__, as alleged. Paragraph 2 is denied. On-site signage at time of the alleged breach was sparsely placed, inadequate in prominence and was not apparent to the Defendant and thus no acceptance of any alleged contract took place. Whilst the Defendant is the registered keeper, paragraphs 3 and 4 are denied. The Defendant is not liable and has seen no evidence of a breach of prominent terms. The quantum is hugely exaggerated (no PCN can be £170 on private land) and there were no damages incurred whatsoever as a genuine customer.

    Questions:

    Should I add 'as a genuine customer' at the end as I did shop in Tesco that day?

    I am concerned BW Legal wrote the POC as one big paragraph because in other examples I've seen they list it as numbered points or there are breaks to distinguish paragraphs.

    The layout of my POC is:

    In other court claim POCs I've seen it has been listed it as points (1., 2., 3.):

    Are they trying to catch me out or were they just lazy when submitting the claim? Sorry to be paranoid about this.

    Should I still write it as 'paragraph 1 is denied' 'paragraph 2 is denied' etc or change it to something like 'the first point is denied' 'the second point is denied' and so on?

    That second picture isn't a BW Legal claim, that's a DCB Legal POC. So you aren't comparing like with like!

    Yours looks typical for BW Legal to me.

    Nope because you parked outside of bay lines. Why? Minimal on the line overhang? Slightly angled due to other cars or a corner/obstruction? Small bays not fit for purpose to accommodate modern cars?

    Or really poor parking that took up two bays? (I hope not … as you'd likely not win at a hearing).

    You need to explain and properly respond to the allegation.
