UKPC charge for "commercial vehicle" parking
(Image removed by Forum Team)
Hi all,
I could not make this up: At the start of this month ParkingEye discontinued a court case for a PCN for which they'd chased and harassed me for four years. Days later I get a new PCN…
I would like your advice on how to go about this: The charge is because no commercial vehicles are permitted on site.
My vehicle does have decals on it advertising a business, but doesn't comply with any other criteria for a commercial vehicle.
- It is not registered as a commercial vehicle and insured for personal and business use.
- The primary use is personal. The business use is to travel to locations, it is not transporting tools or materials for a trade or deliveries
- Vehicle is a passenger vehicle, not a van (Tourneo rather than Transit), with 5 seats.
I will ask a friend to take a picture of the signage as this is not accessible via the internet and I am not local to that area.
Thanks so much for your help.
UPDATE: I amended the image. Thank you for pointing out my error.

You have left your name as well the Parking Charge Reference showing.

If the allegation was true, its forbidding signage , therefore
No offer, no consideration, no contract ( possibly trespass, which has nothing to do with UKPC. )
If the vehicle was on private business, and complied with the signage rules on private parking, then no breach was committed , the parking company contract was offered, considered and accepted
Clearly a foot patroller with an incentive to find alleged transgressions and let others decide
Who would have thought that commercial vehicles are banned from a retail park. ?

Your image has your name and PCN ref on, so you should delete yours.- Can you go back on foot and get pics of the signage at the entrance and the full signs inside the car park?
- Go online as if to pay, because there should be a photo of the sign among the 'evidence'. Show us that.
- From their online pics: exactly how many mins/seconds between the first and last picture of the vehicle?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

How do you define a commercial vehicle?
A plumber may use his to liveried van as a family run around, in which case it wouldn't be on site in a comercial capacity.
A hire,a lease or a courtesy car on the other hand is the very definition of a comercial vehicle.
Plan A complain to the retail park owners stating the non commercial nature of the visit, reminding them they are jointly and severally liable for the actions of their agents, and they have accessed your details without just cause in breach of UKGDPR
Also there could be a CMA complaint in there as well

Thanks! Ref removed.

You would honestly think that if these halfwitted muppets didn't want commercial vehicles (what ever that means) on site they would state that at the entrance wouldn't you!

Thanks so much. I am 200 miles away but asked a friend to go back and take a picture and send it through.
Went online as if to pay and while there is a picture of the sign, it is not legible but I attach it here.
Their online pics do not include time stamps.

"Went online as if to pay and while there is a picture of the sign, it is not legible but I attach it here."
That's the whole point - you will be using it as evidence for POPLA!
You won't be showing your friend's images, they are for us to see.
Their online pics do not include time stamps.
OK, interesting…so what timestamp is on the photo on the NTK?
If none, then there is no evidence AT ALL and no 'period of parking' on it. A single alleged time - with no proof by way of a datestamp on any images - is not a timeline or 'period of parking'.
That is required under POFA Schedule 4.
Therefore DO NOT ADMIT TO DRIVING.

Thank you @Coupon-mad . I am attaching the images of both the sign at the entrance and a better image of the actual rules to this post. On this image you can see that commercial vehicles are prohibited, but even if I saw a sign like that, I would assume that I can park my car there. As described, it is a passenger vehicle, a normal car and it is taxed and insured as such.
I had to download the images provided as evidence on the UKPC website as I did not see a timestamp at all. Once downloaded, I could zoom in and the timestamps on the 3 images are 18:42:22, 18:42:37 and 18:42:49.
