Lost car finance payments

Someone will have to go through the accounts (thousands of payments) & find your payments. This will not be a quick task.
You need to give them time to sort it out. Ringing everyday is not helping.
No you won't get funds back for fixing car, just the same as you would not have done if there were no finance issues.

Have you raised a complaint as suggested?

Yes the complaint has been raised and they are "investigating" a process which apparently takes 8 weeks.
She has been told now that in the meantime they are still going on with the vehicle recovery and that the recovery team will be in touch again on Monday.
Is it easier to continue the complaint when she no longer has the car or should she try to keep it while they continue the investigation?
Surely they have breaches the contract so will she be liable to still pay 50 percent of the total bill or would the contract be void?
I am happy to buy her a replacement car but we dont want to be paying two lots of finance for their miatake.
She also today recived her reminder email for the direct debit they set up when she purchased the car advising the funds will be taken from her account on the first of the month.... she will keep that open so she isnt the one in breach of contract though.

How have they breached the contract? Incorrectly stating she's in arrears isn't a breach.

If a recovery team turn up just tell them that you are in dispute with the co over the debt & that unless they have a court order to remover the car. You will be calling the police.

If they take a car back saying she hasnt been paying when all the evidence shows she has.... surely thats a breach? Just the same as if she hadnt paid she would be in breach?

She had spoken to them again today and they acknowledge her complaint but are still going ahead with the thw collection...
How is this possibly fair? Surely the investigation should put things on hold as it takes 8 weeks.
