TSB unauthorised overdraft

I’ve recently had contact from a debt collector about an unauthorised overdraft of £800 on an old account I had… so old I don’t have any details for and didn’t come up on a credit search when I started a new job.
TSB claim there is nearly £800 overdraft used which was unauthorised yet how can they have allowed me to use so much money over a period of several months if it was all unauthorised?!

Where do I stand with this as I didn’t realise there was an amount building.
At the time I was signed off work, via PIP, ESA etc with a physical disability so my income was extremely tight living from one benefits payment to another.
I didn’t and still don’t have any savings or way to pay this back without being in hardship.

They have now threaten to come to my address to claim it back

Any help would be appreciated.

They have as much power to enter your house as the milkman does.

Write to them with the standard prove-it letter template which you can find on this site and dont engage with them any further at this point.

Saying that, how long ago? Is it more than 6 years?

There are a variety of ways, transactions that can't be returned unpaid such as subscriptions via a debit card, they may allow you into an unauthorised overdraft up to a certain threshold (probably not the full £800 though), there were undoubtedly some charges added too.

It's not likely a bank willingly let someone on benefits/low income run up an £800 tab though, however if you want an answer you'll need to get copies of statements from the time.

How many times have you moved in the years that mean you can't remember the account?

If you went overlimit & moved, so they can not trace you. Then interest on the debt does not stop,

Sadly many people that if they do not have a overdraft, they they can not go into a unauthorised O/D.

I was sick so paperwork got missed. This is the first I’ve heard of it for TSB. I don’t have an account with them. It doesn’t show on credit report.
not idea who long ago it was as I understand if they haven’t requested it for 6+ yrs then it’s more difficult for them?!

  • Probably the reason it does not show on your credit files is that the account has been closed down and the balance is in their debt collection section.

You really need to find out the date of default on this account.

Not appearing on a credit report isn't conclusive evidence of an account not existing, but if you really are sure that you don't have an account with them then lodge a complaint, if you're convinced that they're just making this up (which I have to say would seem unlikely).

If the debt no longer shows on your credit reports, that suggests that it was defaulted over 6 years ago, does that sound likely to you?

And you have no made any payments in the last 6 years to TSB or any debt collector?

Who is the debt collector that has now contacted you, and do they say who they are acting on behalf of, they may say "our client TSB" for example, or give another name..

@sourcrates could you move this to the DFW board?

yet how can they have allowed me to use so much money over a period of several months if it was all unauthorised?!

If you used a guaranteed method of payment (cheque, guarantee card, or debit card transactions below the floor limit), then they have no choice.

Did you have accounts with Lloyds Bank, LloydsTSB, C&G or Halifax? A number of branches saw accounts rebranded within the group and Lloyds split off a number of branches which now trade independently or Lloyds under the TSB brand.
