Parking Control Solutions LTD- Moorside Legal
Hi all,
This is not my first rodeo but I have 3x LBCs totalling £1360 for parking tickets over 2/3 years ago
I know the process, just wondering if I can 100% assume I will get a court claim for this? I know it sounds a stupid Q
For context this was a gym I have parked in, and I have entered my registration plate late, this happened a couple times but I ignored the PCNs,
Please do let me know your advice and experience with PCS and Moorside legal
Many thanks!

Yes Moorside will issue claims.
If you have 3 separate LBCs I'd reply to one, and ignore the other two.
Let them issue separate claims because it reduces your risk of losing big because it gives you the extra defence point of Henderson v Henderson (cause of action estoppel). Makes subsequent claims have lower merit. They'd all need defending though!
Who do you mean by PCS exactly?
Company number & full name?
Show us some signage as well.
What do you mean you entered your VRM 'late'? While you were still on site? Did you always do it, never missed? Just took longer than ten mins each time?
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

For contexts, here are the letters. I have heard that moorside legal sends fake LBC's? Is this the case? @Coupon-mad ? Many thanks

Parking control solutions limited, was a long time ago. Had a similar case with excel which you helped me with and I won. Do these guys take things to hearings? Many thanks

Moorside take cases to hearings but don't turn up. The Defendant still has to.
Most defendants win but someone lost against them today because they failed to send a WS and evidence and didn't use the usual Chan & Akande argument we advise for these cases.
So basically that D defended but then (prior to the hearing) didn't do a WS and offered nothing by way of evidence.
You won't make that mistake as I recall you are good at following our advice to the letter.
Yes that's the short fake one.
However here is a bespoke tactic for your case:
Respond to the two 'big money' ones on Moorside's Portal - one this weekend and one next weekend to make sure they don't spot the connection - and deliberately slow those two down by asking for copies of the PCNs so that you can understand the issues.
Do not say 'ALL' PCNs, just 'the PCNs you are pursuing' and make sure you put in the right reference number from the right letter.
Say you know you are entitled to these documents under the pre-action protocol. Tell them they have 40 days to supply these documents.
DO NOT refer to the other PCNs or the other LBCs. Do these replies a week apart.
IGNORE the £170 one and let that one carry on faster to the Claim Form. That's the one you want to defend first!

Once you receive the real LoCs there is a further tactic to slow down the two biggies.

Yes but I already told you in my first reply what extra argument that gives you.
